quote]LOS ANGELES (AP) A New York man has been sentenced to a year in federal prison for illegally uploading and distributing a copy of "X-Men Origins: Wolverine" before the movie's premiere.

Forty-nine-year-old Gilberto Sanchez was sentenced Monday in Los Angeles federal court. The judge also imposed a year of supervised release and numerous computer restrictions.

Sanchez pleaded guilty in March to one count of uploading a copyrighted work being prepared for commercial distribution. Prosecutors say he admitted uploading a "workprint" copy of the 2009 film about one month before it was released in theaters, then publicizing the upload on two websites.[/quote]

Harsh sentence?

Or did he effectively 'steal' thousands of dollars or more from the film company's coffers through lost ticket sales, by allowing people to watch his pirate for free instead of going to the cinema or renting it on dvd?

Was he a simple uploader and file sharer or was he somehow connected with the film company/distributors? Did he have privileged access? That would make a world of difference in my opinion.

well, if he was the original uploader as the article, weakly suggests, he must have a film critic contact or a contact working in / for a production company to have to leaked to him from.

I think if he was the person working in the industry, the article should have mentioned it. Perhaps it is as I suggest and he protected his source, hence no mention (yet) of the original source?

Copyright breachers should get fines and/or community service. Prison seems a bit much for movie distribution that he probably didn't even profit from (unlike back in the days of bootlegs).

Nope, that'd be too complicated. Throw them in all prison: rapists, child molesters, murderers and... X-men thieves.

I watched an interview of him when this was first going to trial. He claimed to have bought the vid "on the street from some Korean guy", and then shared it on torrent sites he was a regular member of.

I don't care if he knowingly did it. Prison is crazy. So, now we're converting a member of socieity who otherwise would be working and paying taxes into someone who will not only be costing us money while imprisioned and being surpervised on parole but will now have a crimina record and unable to find quality employment and nothing close to the job he had prior.
Completely insane justice system we have in this country. Meanwhile if the CEO of the company he downloaded the movie from broke a law the company gets a fine or slap on the wrist and he has no criminal record because we treat companies like special people in America.
I'm not saying there shouldn't be copywright laws or consequences of violating them but movie and music companies continue to make tons of money in this pirated copy world we live in. Not an excuse to do it but its overblown. Its more about greed than poor companies who can't make a buck. They make plenty. They just can't be as gluttonous.

.

From the linked article

Sanchez has a prior conviction for a similar offense.

So, if we go by your theory that prison makes people unable to find quality employment...the job he had prior probably wasn't anything special.

And how do you know he would be working and paying taxes? Maybe he's unemployed and drawing unemployment benefits or on welfare or living in his parents' basement.

Not that I'm going after you...just seems like a whole lot of assumptions you're drawing here...not quite sure how you are arriving at them.

Every job application in America asks if you have a conviction. Depending on the type of job and how extensive, companies do background checks.
We over convict for small matters I think in many cases. DUI from years back when someone drove home drunk from a frat party can keep you out of a job.
Some companies are wise enough to look at the actual offense and the length of time. Should a 30 year old be forever penalized for a DUI driving back from the Kappa Alpha party?
I still don't think the guy should see jail time but we are in a society where any offense against a corporation is a major deal while they get away with far worse things. If anything we legalize a lot of wrong corporations do us. At least level the field.

I mean, I love Almodavar, but I'll hapilly not pay to see one of his awesome movies rather than pay, if I can get away with it.

Yeah some random schmoe uploading a 700MB version of the movie shouldn't be doing time, that's nuts. A fine of a few grand or something.

Now if he was say a distributor and had privileged access then I could see the year in prison. That's kind alike embezzling from a bank as an employee or something like that. There's a much greater breech of trust involved.

Wow...I bet he wishes he went to jail for distributing a better movie.
