Hello,

I have a friend who got a misdemeanor in the U.S. (public intoxication). She wanted me to find out how/if this effects an FBI background check/employment in South Korea.

Negatively.

You're welcome.

On a serious note, it generally will be a bar to being accepted for employment here, although some people with such a record have obtained a job and visa.

No. I'm saying that it will lower your friend's chances quite a bit. The chances of getting a job and visa with any negative information on the background check, even if exonerated, are quite slim.

There's nothing she can do except try to apply for the visa. They'll either approve it, or they won't. It will depend on the guy at immigration and how he interprets the rules/if he's having a good day or not.

I think she still has a chance, but he answered your question, it will have a negative impact, but not necessarily a final impact.

Just tell her to apply for it. She still has a chance.

I sent my background check in recently and asked a similar question to an fbi person. Only crimes for which you have been fingerprinted will show up on the check. If you're friend was not fingerprinted, then she'll be fine, if she was, it's going to show up.

What was she originally charged for?

If she's from the US, her conviction was most likely reduced from a much more serious offense.

Everything here is simply speculation.

GET THE CHECK.

If there is nothing on it her chances of employment are 100%.
IF there is anything on it her chances will effectively drop to "0". Choose another country.

I currently work with a person who got busted for DUI.

Immigration gave him a visa.

So who really knows?

The moral of the story: It can't hurt to try.

If you are in the United States being fingerprinted DOES NOT mean you will receive an FBI CBC indicating an arrest record. It will depend on the laws of the state in which the arrest took place. The reporting of arrests to the FBI's criminal database is determined by state statute. The federal government does not go trawling for misdemeanor convictions. If the arrest was of a class not automatically reported by the arresting state to the federal database, then regardless of whether or not you were fingerprinted, the record will not appear on your FBI check. Each state is different. Some states report any and all offenses, some only those of a certain class or higher. Also, contrary to what you may read on these boards, having a record expunged does not in any way provide one with a "clear" record. The impact of expungements, and the processes thereto, can vary from state to state and are not in any way a guarantee that one's record will be wiped clean.

I have a criminal record because of a fishing ticket!
I caught one too many fish and completely forgot about paying the ticket.
So I was issued a warrant and arrested. This was 10 years ago.
I'm fortunate to be a gyopo and do not need to submit a crc for visa purposes.

And this is why a number of us consider the way the CRC requirement is implemeneted, not the CRC requirement itself, to be discriminatory.

I think pchi may be talking about getting an F4 visa. If pchi wants to work with children, they will still need the CRC, in which case they will have a record and thus will probably be denied employment.

Maybe I am mistaken, but there is no real advantage for pchi, despite what their post seems to imply.
