I just re-signed. See any holes? I left out addresses and such.


Teacher��s Benefits

A. Salary: Payment for one month worked in a teaching term is 2,300,000 Won. The salary will be paid per month on the 5th of the following month.
The teaching level will include elementary, middle school and adult.

B. Overtime Pay

All teaching hours in excess of 6 hours a day are considered overtime. Overtime will be paid at the rate of 20,000 Won per hour.

C. Housing

The school will provide a single furnished apartment. Furnishings provided by the school for common use include: a bed, a kitchen table and chairs, a fridge, a computer, a telephone, a television, an air conditioner and a washing machine.
The teacher will pay the cost of monthly services, utilities and telephone charges for housing.

D. Airfare

Employer will purchase for employee an economy class ticket for passage of a regularly scheduled airline from Korean to Montreal, QC Canada or cash equivalent. This will provided at the time of completion of employment

E. Severance Pay

On completion of his/her responsibilities of the year contract period, according to Korean Law, one-month salary shall be paid as severance pay.

F. Paid Vacation

The employee will have one week (5 working days) paid vacation in winter and another 5 days of paid vacation in the summer according to school vacation. The vacation time is announced to the employee at least 2 months in advance. The paid vacations are in addition to the 3 paid sick days per year. A physician��s approval is needed if the employee needs to take more than one sick day at a time.

Teacher��s Obligations

A. Supervision

The teacher will work closely with program supervisors and other colleagues in the planning, observation and review of intruction.

B. Behavior

The teacher should respect the rules and standards of conduct of the school (written, verbal and tacit) and obey the laws, regulations, instructions and ordinances of the national and local government.

C. Workload

The teacher will teach usually about 30 hours per week (6 classes a day) from Monday to Friday, teaching elementary, middle school and adult only.

D. Staff meeting

Meetings and school events will be scheduled a the discretion of the school director. Attendance is required. Writing evaluation reports about grading and assessment is required.

E. Work Schedule

The workweek runs from Monday to Friday. Hours of operations are between 2 and 9 pm (or 2:30 to 9:30). Teacher will be scheduled to teach six classes a day and each class of 50 minutes will be considered an hour during this time period by the school director.

Employer��s Obligations:

1) The employer shall provide the employee all books and required teaching materials with full support. The employer shall respect the employee��s dignity and try to keep their relationship harmonious with the employee.
2) The employer shall pay the salary, as stated in this contract and in case the employee requests extra and required teaching materials, the employer shall support these with utmost efforts.

General

A. Taxes: South Korean income taxes will be withheld automatically from your monthly salary.

B. Health Insurance: According to Korean Law, employer and employee have to pay half the amount each.

C. Pension: According to Korean Law, employer and employee have to pay half the amount each.


Termination of Employment

The school reserves the right to terminate this agreement for cause with written notification 30 days in advance. The teacher agrees to give written notification 30 days in advance of intention to terminate this agreement or of interest in renewing it. The employer reserves the right to dismiss the teacher from employment for the following causes and must be according to the relevant Articles of the Korean Labor Law:

1. Neglect or inability to perform his duties stipulated in his agreement
2. Unreasonable absences from work.
3. Receiving two warning letters.
4. Criminal behavior or misconduct.
5. Teaching any private classes outside of the school


Early Termination by Teacher:

In the event the teacher breaches this contract by terminating or giving notice of termination during the employment period (which is a year until the termination date), the teacher shall reimburse the one-way airfare and must pay the return ticket fee to the school.

Contract Period

The period of this contract will be one year, from the 3rd of March, 2006 to the same day of March 2007.

Miscellaneous Provisions

1) The employer and employee


Blah, blah, blah. Employee retains one copy and employer retains 2 copies of the contract. Signatures, etc.

Agreement between Mr. Employer and teacher to pay teacher 1,000,000 Won for return flight not taken as cash reimbursement. The cost will be divided 100,000 Won a month for the first 10 months starting from March salary, 2006.

No Complaints, just questions

salary will be paid per month on the 5th of the following month.

Why cant they pay earlier, it isn't a big deal, except you have already worked a month and they had that time to organise the money and they still cant get it to you. How much interest do they earn.

How far do you live from there, could they make it to the nearest city?

Hagwon job right? They won't give you 2 months notice, 2 weeks is good for most of them.

How much unpaid pre-time is added to this? My school adds another 20 hrs a month and more and we dont do more than 5 hrs a day, so how much more will u need to do?

I'm from Fredericton, NB. I was telling him that he should send me directly home and he was going on about "I'ts normally to Montreal, Toronto or Vancouver." Going on about it just hurt my head. Plus I'm probably going to go to Montreal anyway, so I had that put in my contract.

My shift is 2 to 9. Anything before and anything after is OT. Anything above the defined six 50-minute teaching hours/day is OT. If I'm there 7.5 hours and teach 3, I get 1/2 hour OT anyway.

I actually had him change it on the contract to 30 days because it's the law. It works in my favor as well. Not that the contract has anything to do with it.

There are some things I don't like in this. That Montreal flight thing kind of bugs me. I don't know where he gets off thinking he doesn't have to send me to my hometown. I didn't argue just to let him think he at least won something. I also don't like that flight thing being paid monthly. The last thing I don't like is the 2-9 or 2:30-9:30. Thing is, I get picked up at the same time as everyong else (in the country) and I'm there automatically at 2 and start teaching at 2:30. If he makes me teach 9-9:30 he's probably thinking he doesn't have to pay me OT for that half hour. Little does he know, he will have to. It's not my fault I'm not a 5-minute walking distance from the school. Anyway, he gave me a 100,000 Won raise and I'm not the type to be walked over. He over deducted taxes last year (3.7%) and I'm pretty sure he didin't pay the tax office. I at least got him to reduce it to the correct amount for my new contract (2% or whatever). It's always nice to have a weapon.

Anyway, all in all, not too bad a deal.

I would change this to:

If the teacher breaches this contract by terminating or giving notice of termination during the first six months the teacher must repay the airfare. After 6 months the airfare to Korea will no longer need to be re imbursed.

Yeah, I was thinking about that, but whatever. There actually is no airfare to Korea. He never paid for me to come here. It's funny. It actually won't matter in my case anyway. I suppose that if I quit in the 9th month that they won't have to pay for my flight home. That's understandable. Him paying the 1 million for my return flight in 10 separate payments is his security. I'll give him that. I already signed anyway. I may, however get a couple of things changed even though we both signed. We're going into immigration on Thursday together and he can't do anythign without my passort and ARC. I might touch it up a little more and do the signing thing again because there's nothing to reimburse here if I quit early. Notice is enough. I might get him to change the 1 million for 2005 flights to giving the remainder if I give proper notice or if he cans me. Neither will most likely happen though.

I think you got jipped on the flight to Montreal. A flight to Montreal would cost more than a million won and a flight to Fredericton would probably cost even more.

I don't understand why he can't pay you the entire amount of the flight right now. If you would not have resigned he would have had to pay it now anyway. Is this school having financial difficulties?

He gave me 6 million Won today (one month salary, one month severance, vacation days not taken, and OT). I'm the one who brought up paying me in portions for the 1 million Won. You can actually get a flight to Montreal for about 6 to 700 million Won. I make 3 to 500 thousand a month OT and 3 months of the year, I make over 1 million on top of that for OT. I also got a 100,000/month raise and my boss has paid all my pension to date (one year's worth) which I get back when I leave Korea.

Maybe it just gives him some assurance that I'll stay since he didn't fly me home and there's no flight to Korea money that I can lose.

Looks pretty good Jacl. Was only wondering why you didn't have the appropriate percentages added for the withholding tax(2.14% on 2.3mil), health(2.24% each for your and employer's contributions), and pension(4.5% each for your and your employer's contributions) deductions. You may want to consider doing this to keep your boss honest this year(or at least try to) Wink . I like the contract though. Nice and basic...no ten pages of penalty clauses, rules and regulations, and other ambiguous garbage like many contracts we see.

No major problems with it, you are happy there, he has paid you what he promised. I do agree with Grotto regarding the termination clause. Try and make it favour you more than your employer, otherwise keep enjoying the experience. Smile

For a newbie contract, this contract is definitely above average. Higher salary, block shift, 6 50 minute classes. They are being a little stingy on the airfare by making you fly out of Montreal, but that isn't that unusual. I'd say that's a very minor sticking point in what looks like an otherwise good contract.
