13 month visa to d-10

my arc card expires on march 28th and i'll be looking to change to a d-10.

my contract actually finished on feb 28th so i took my honeymoon and just arrived back in korea this week.

i understand that i should have reported my change in work status (unemployed) to immigration but didn't find out til this week, well past the time i probably should have.

with that being said, if i pop over to change my visa, would they be any the wiser? could i just tell them my job finished yesterday?


my arc still has 5 days left. even after that time, do i still have the 14 days to leave/sort something out?

Depends. They know where you worked so it would be fairly simple for them to call up and check. Plus didn't your boss report that you were finished to Immigration (so he could free up that visa slot)?

i'm not sure that my boss did that, they were hoping that i'd be back in april to re-sign.

If your ARC hasn't expired yet, you should be good to go. Go to immigration and get your D10 before your ARC expires.

If your boss reported you as finished in March and you tell them you finished in April you may well be. If your boss didn't say anything then you are likely home free. But as we all know each Immigration Office tends to be a law unto itself. You might get fined, or get off with just a warning or it might escape their attention all together (they might not even ask specifically).

I wouldn't volunteer the information but if asked directly admit the truth and plea ignorance. Not that that is an excuse but it may mitigate the consequences (if any)

@Rutherford.
It doesn't matter how much time your ARC has. If you end your contract AND you wish to stay in country legally (you must report your status to Immigration within 14 days. For an E-2 anyway.

If your ARC expires you start the E2 process from step 1.
If your ARC expires and you are still in Korea you get dinged for an overstay (probably just fined), a black mark in your file and complications for future visa applications. (DON'T OVERSTAY!!!)


Get thy butt down to Kimmi or buy a plane ticket home - pick one.

i shall plead ignorance that i didn't know and that i thought it was the final date on the ARC card (which is true).

i'll check with my old coworkers if they can ask whether my visa was cancelled. i doubt it as they've been asking me to stay another year but you never know.

if they do fine me, any ideas what sums we're talking here. i don't mind paying because i was ignorant but i'd rather it not be in the millions

5 days before your ARC expires then a warning for failing to report your change of status and 60k to change to a D10.

1 day AFTER your ARC expires = 100k won fine and issues with kimmi that MAY preclude a successful future E2 application.

IF you re-entered and were NOT given a tourist entry stamp (30/90/180 days - depending on your nationality) then your E2 was not canceled.

well i'll be going on monday, so that'll be 2 days before my ARC expires - 60k fine i guess


as for the tourist stamp - no idea. i've got my departed and admitted stamps from last week and the admitted one has no date on the 'until' part.

however, my previous stamps all seem to have an 'r' handwritten in the until section (re-entry?).

x days BEFORE ARC expires = no fine (but possible warning for not reporting your change of employment.

I would suspect, if you still have your ARC, that you are still on your E2 entry and it was not canceled.
