What are my rights?
Immigration recently changed the rules regarding the F2-99, Applicants are now required to make 1.5 times the GNI of a Korean person. This is somewhere between 36 million and 40 million won a year according to the immigration official. A heady sum for the average E2 holder to make legally.
Do I have the right to protest? Do I have the right to demonstrate against this? They didn't even update the immigration website. Furthermore when I asked for a copy of the rule changes the official in charge told me that, my request was unreasonable. I asked him how can I follow the rules if I cannot see them? He said "I can explain them to you."
What rights do we have? If immigration can change the rules year to year at a whim, how can we ever expect to get ahead legally in this system?

I ran into the SAME brick wall when I tried and there is no recourse.
It remains in the hands of the Minister of Justice and he (or his aid) makes the final decision (even if you did meet all the criteria you can still be refused). Unless you have connections in higher places than I did...
try for the points or get married.

I was told by the immigration official that my Masters from Texas A&M will no longer be considered for the points visa that they changed the law to only include graduates of Korean Universities. Might wanna check up on the points visa. Immigrations website is BS, and they havent published the new rules anywhere. Kinda amazing we arent even allowed to see the new rules. |
