Ricci v. DeStefano is more complicated than that.
A New Haven Fire Department written test revealed a disparate impact in its results, and only 8 vacancies were open, but all of the top 10 were white. New Haven discarded the tests and promoted nobody, because they were afraid they violated Title VII of the Civil Rights Act. The Court struck down New Haven's response, and said the city violated Title VII when it took remedial action, and should reinstate the tests.
The aptitude test wasn't challenged, but instead its removal was challenged. The test was upheld and reinstated, and rightly so. |

Egalitarianism at the barrel of a gun!
All firms that are worth working for discriminate. They demand a university degree for general jobs, a STEM degree or professional designation (CPA/CFA/bar passage) if you want higher quality workers and then filter them all down by demanding experienced workers (meaning they showed up to work and produced for years). This filters out all the people that would have been initially caught by an IQ test. Unfortunately it means we all have to drop a hundred grand on university and designations. Much easier to just eliminate the idiots and have firms train the competents. That would be discrimination though. So we all get half a decade worth of hoops to jump through. |

More state tyranny in action.
Blacks and hispanics are underrepresented at a school. Said school is therefore guilty of some form of discrimination. Notice the article says nothing about the likely massive overrepresentation of Asians, who seem to get into elite schools at greater rates than whites.

The Thomas Jefferson High School for Science and Technology, a prestigious Alexandria, Va. high school, has been hit with a federal civil rights lawsuit.
The Coalition of The Silence, a local minority advocacy group, and the NAACP filed a complaint to the U.S. Department of Education Monday alleging that black and Latino students, as well as students with disabilities, are being shut out of the school because Fairfax County consistently fails to identify them for gifted programs
"Poor Latino kids are not being identified, and I worry part of that is language," Martina Hone of the Coalition of Silence told NBC Washington. "African-American kids are not being identified. I'm worried that's race."

How can an aptitude test give complete information on an individuals ability in learning and doing a set of tasks? I typically do really well on aptitude tests, but not so well in grades. There are many things to look at. |

How can an aptitude test give complete information on an individuals ability in learning and doing a set of tasks? I typically do really well on aptitude tests, but not so well in grades. There are many things to look at. |
Like the CPA exam? The CFA, CFP? The Bar?
Hire everybody and whoever Hopes the most gets promoted. The post-meritocracy economy! |

The writer above calls the FDNY decision the "diversity beyond parody event horizon". Can't say I disagree. |

Egalitarianism is consuming itself.
Progressive superstition holds that it is solely a lack of "education" - whatever that means - that keeps Diversity down. The other progressive superstition (Diversity is kicked out of school because of racism and as such we have to stop punishing disruptive Diversity) will further ruin schools. Round and round we go.
Maybe these are conspiracy theories and not superstitions? A combination of the two? Either way, extrapolate this government behavior twenty years into the future and ponder what an American public school will look like. |

| Next term, SCOTUS will hear an affirmative action challenge. The US high court will probably either narrow or sweep away the entire justification of affirmative action. That will effectively moot the premise of this thread. |
