Come to Korea March 2010, submit a Winnipeg police check to immigration in Daegu to get an E-2 visa. Work at same hagwon from March 2010-March 2012
Move to Seoul in March 2012, give my docs (including RCMP check with apostille) to my director on the day that he goes to immigration for me. He returns later in the day to give me my passport and ARC back, both show that my visa has been transfered over to the hagwon in Seoul and now show an expiry date of March 2013 (for 1 year).
I ask for the original RCMP check back and he tells me that immigration took the original and he has a photocopy. I had my doubts about immigration keeping the original but I confirmed that they do in fact keep the original RCMP check.
OK, it all seems to make sense, after all Korean immigration changed the law and to renew/extend my visa in March 2012 I needed to submit an RCMP check (I did not before) of they would not renew/extend. Since they did renew my visa for a year and I had it confirmed that they keep the original I had no reason to think that there is any trouble.
My current situation:
Fired from my current job July 13th, BUT staying until the end of the semester so my final day will be August 31st. I have an interview for a public school job next week and they need a copy of my RCMP check which immigration should have on file.
Today I go to immigration (Mokdong) in Seoul and am sent to the 7th floor to get a copy. The immigration officer stuns me by bringing out a copy of my Winnipeg police check and notarized degree from 2010!!!!!! She says that the RCMP check was never submitted in March!!!!!!!!
This makes no sense........my boss had the original RCMP check in his folder (I SAW IT WITH MY OWN EYES) comes back 2 hours later with the ARC and passport showing the visa renewal and tells me that immigration kept the original RCMP check (which I confirmed that they do). I don't care who screwed up, I just want to deal with the issue at hand.
My boss double checked today and he only has the photocopy of the RCMP check, I also have a photocopy at my home (although I will be making more just in case) of the apostilled RCMP check.
As it stands now:
Boss is not angry with me, just does not think I am suited for kindy (he is probably right). Giving me the release letter so no worries there.
I can provide the public school with a photocopy of the RCMP check but what's the deal with immigration?????? If they say they need the original RCMP check (when I transfer my visa to the public school) I can say to them "well you would have had to have seen it to give me my extension in March, right?". And of course I do have the photocopies of the apostilled RCMP check AND my ARC does not expired until March 2013.
As an aside......will I transfer over my visa to the public school (which I start at in September) only until March 2013 or would it have to be for 1 year????
As another aside....I could live with it if they say gave me until March 2013 (my current ARC expiry) to obtain yet another original RCMp check with apostille.
Am I screwed???
Although I am very upset, I appreciate honest and frank advice!!

Update: I phone immigration today and they tell me that I submitted a local police check (from Winnipeg police) in 2010 but that it included a national wide check so they have that on file and the RCMP check was never needed.
My guess: a lazy immigration officer saw that the Winnipeg police check with a national check was already in the database and didn't bother to put the RCMP check into the database. I can't beleive that I never actually needed the RCMP check after all the BS I went throught to get it.

Generally when you give papers over to immigration they take and keep it. So getting the CRC back from immigration, no. Still I would suspect they would have it on file. Maybe they do have it on file in a folder but not scanned in to your computer records. Also did you go to the same office as your boss did. Things do get messed up. I once asked if they had my records on file, and they showed me some images. Go back a few months later and they could not find them. Lucky I had extra paperwork.
Now if you boss is going to allow you to transfer with a LOR, then you do not really need your CRC. Likely the recruiter is trying to cross all the T's and that. Still they would like a scan of your CRC. You might have to explain to the school and recruiter that you do not need a new CRC, but you will get another one in the works.
As to timing, if you can transfer, you can then extend your contract. Immigration will change your info and extend the time.
Also have you tried getting a city/province police check. Those can be quicker at times and should be accepted. As long as the CPIC is checked immigration should take it. Problem is many recruiters and schools think JUST RCMP. They can be sticklers about it.

Why don't you go to immigration again, take a number and when just 2 more people are ahead of you, call immigration and ask them if they have the original. If they give you the same answer, "Yes, we do", then ask them for their name. When you get called up tell them you want to speak to that person. See for yourself if it is a copy or the real thing.
I would bring a Korean from the school if the owner couldn't come to explain that they gave it to the school. It's possible when talking to you, they aren't thinking all the details out. They just see the copy and say "Yes" regardless if it is new or a copy.
In the end, will you need it again? Not likely, I would think they would want a new one. Aren't these CBC only good for 6 months? If you had to get a new one, then I don't think the one you gave would be accepted. |
