3.2 Severance Payment : Employee will be eligible to receive a severance payment in accordance with the Employment Retirement Benefits Security Act. Severance payment is subject to Korean tax regulations.

Modifications: �
Before the Korean Employee Retirement Benefit Security Act came into effect, severance payment was made after each successful completion of Employment Agreement. In accordance with the Korean Employee Retirement Benefit Security Act, severance payment will not be disbursed at the end of each contract, but will be accumulated and held until the termination of employment, excepting conditions set forth by the Act. Accordingly, the current section 3.2 of Employment Agreement is modified.

Legal Basis:
Employee Retirement Benefit Security Act came into effect on July 26, 2012. ( Article 8, Paragraph 2 and Article 3(1) of the Enforcement Decree ) |
I understand that this is more than just the school doing something, they're acting on a law change, but is this contract addendum common? Is everyone getting these? Was a bit put off to get it in my email while waiting for flight info. |

The new law immediately trumps anything already written otherwise in people's contracts, so if anything this was considerate of them to spell it out for you.
Sudden changes like this are rare. |

If you are put off by Korea's legal changes, wait until you experience the school's changes.
Maybe Korea isn't your kimchi heaven.
Why would you dispute legal changes? Are you wanting to drive on the left side of the road when Americans have to drive on the right? If you are a Briton, do you want to drive on the right when the Britons drive on the left?
Be put off all you want, legal changes are not something you can dispute on your own. Raise your snooty nose at that.
The real question I have for the original poster is why on earth would you sign a 1 year contract and bitch about 2 years?
Leave after 1 year, and you get your severance. Business as usual buddy boy!!! Or were you planning on working for them for 50 years and retiring? There is a reason why Donald Trump doesn't teach ESL in Korea. |

I expect the result of this new "law" will be a lot of teachers will choose to
change schools every year, just to ensure they get their severance. |
