My director at my school want to fire me 3 weeks before my contract ends. Her reason is that I don't smile enough at work.
She also claimed that if I don't smile she will refuse to pay me anything.
I need some help as to what I ando as I think this is unfair dismissal
Does anyone have some advice on this issue????

School: That's right, we said nothing of it for 11 months, but now we must. Twisted Evil

Teacher: I see, did you know labor board doesn't like 11 month firings? Wink

School: Why is that? Confused

Teacher: Oh, because schools like to try to get out of paying airfare and severance. That's 1.5 month's worth of salary. :::BIG SMILE::: Laughing

Teacher: (Still smiling)Laughing, how's that?

This is clearly in your favor and I wouldn't worry about it. If they don't pay, then you have a good chance of winning. If you have to leave Korea, that will suck. Let us know which school it is after it is all finished if you end up fighting for your last pay, airfare home, and severance.

Also, check with the pension office to make sure they have contributed what is owed.

As far as an unfair dismissal, there is nothing you can do yet until they actually fire you or stop paying. It's just mere threats now.

She has up to 14 days to pay you after your last day at work and the labor board won't intervene before then. So be prepared to stay in Korea for a while to get your severance, last pay, and airfare. Start looking for another place to stay. Be careful about signing anything. She may try to get you to sign something which indicates you voluntarily quit.

This is a cut and dried labor board fight as an illegal dismissal in order to avoid paying benefits.

Document everything then...

Find a Korean speaking friend to act as a translator and head for the labor office.
