I need some advice. I am currently on a D10 visa. I quit my last job in Busan and was taking some time off before finding another one. Well, I did find another one in Busan and signed a contract. Everything looked good except it turned out they lied about the vacation time...my so-called ten days of vacation turned out to be less because the weekends are included in my vacation time.

Long-story short, I said I wasn't happy with this and if it couldn't be remedied I would like to move on. They basically told me "No."

Because I hadn't yet switched over to another visa, I decided to bail. My understanding is that contracts aren't considered legally binding if it's not backed up with a visa. I was never actually employed there. All I did was sign a contract. I mean, you can't break a contract with an employer if you were never an employee, right?

Needless to say, they weren't pleased to find out I bailed. Unfortunately, the hagwon DOES have a copy of my ARC. The recruiter angrily informed me that the hagwon had notified immigration of what I did.

In addition, the recruiter told me that the hagwon "discovered I had stolen an iPhone," so they informed the police. Of course, I didn't actually do this. They're just trying to mess with me.

The recruiter said because they have a copy of my ARC "it will not be hard to find me."

So, my questions are:

1. Should I be worried about the accusation of theft? Are the police going to actually do anything? Seeing as I didn't actually steal anything, I don't see what they can do as they will have ZERO evidence.

2. Will I have problems finding a new job? If I sign a contract with another school and go to immigration trying to transfer my visa, what will immigration do? What if the police have been talking to immigration?

3. If I do find another job, and the old hagwon "finds me," can they try to sue me or anything?

4. What if I try to leave the country? Can they mess with me if I try to leave?

Unless they have you on camera taking the Iphone I wouldn't worry about it. I suppose they could have eyewitnesses, but if you didn't take the phone thier is nothing to worry about. So unless the police arrest you nothing is going to happen and the Hogwan can't do anything to you.

Yes. They're messing with you because you broke the contract. The legality of the contract is a moot point. You screwed them (sounds like you had some reasons), now they're screwing you (sounds like they think they have reasons). It also sounds like the recruiter might be helping them screw with you. Sometimes it's like that. People who break contracts find it hard to get other positions...it's not impossible, it's just not easy.

Not at all. Just get another recruiter, find another employer, talk to another immigration officer. This iphone threat will go away.

You could make the same claim they did. Say they stole a Samsung Galaxy Tab.

Relax, take a deep breath, move on and get another job.

Its time for names to be posted here.

Please post the names of the school, recruiter, and other details. Perhaps another foreigner will be happy to take the warning and steer clear.
