My wife and I put down a deposit on an apartment cheonsae-style so we don't pay rent anymore. As the landlady was moving out, the removal company she hired cracked the screen door (basically running the length of the door). Her son ModEdit(shifty, good for nothing ajossi), told the removal company it was ok and they didn't need to pay for the damages. They simply used some adhesive tape to hold the glass in place and left it for us. He even suggested we move out, which just displayed his ignorance because he isn't in a position to pay us back yet - unless his mother sells the house.
Obviously, we aren't pleased with this and have politely asked the landlady's son (he does all the talking because she is quite old), and he said 'not my problem anymore. It's your house now."
His argument is that it doesn't affect how we live. What a turd. I feel like going round to his house and ModEdit on his sofa. Anyway, I want him to pay for the door, so I need to know who is responsible for the damages. Us? His mother? The removal company?

The movers. And because the landlord told them to just walk, they're now off the hook. If you're paying Chunsae, you usually have to push to get stuff done, even in the case of needing a new boiler!

So in theory, the turd is correct in that he doesn't have to pay it. In reality, it would be nice of them. If you really wanted to turn the turd tables on them, you could fix it, and then bust it again on the way out, I guess.

Ah, but the downside. Sounds like this family doesn't have much coin, so the people moving out were pretty much paid off by your coin coming in on the way in.

For you to get your money back, someone will have to move in after you. If they don't like the looks of that broken door, it could hamper your chances of getting out of that dive.

Then I would still be out of pocket. If he really won't pay for it, then I guess he will have to talk to the movers. What a bell-end.

talk to the movers. in jeonsae, you, not the landlord, are responsible for fixing damages, etc. Wolsae (monthly), it is all on the landlord. One of the benefits of monthly rent, but a disadvantage of jeonsae. bottom line, all fixes are the responsibility of the tenant in jeonsae.

your only luck is with the movers. sorry dude.

That seems like he should fix it. You put the money down on the apartment and I would assume that it's "As Is Where Is". But when you put the money down and agreed to it, the door was not broken. The moving company/the guy are responsible. HE should pay, or he should get the moving people to pay, but it's definitely not you.

I have no legal basis for this, but it was fine, you signed for it, they were moving out and broke it BEFORE you had actually moved in, I'd say it's on him.

This whole thing is going to end in tears for someone. Usually when someone breaks something that isn't theirs they do the decent thing and assume responsibility for the damage. The numbskull son is not only refusing to answer his phone to us, but also the realtor that brokered the deal (who he owes their fee). According to the realtors they managed to get hold of him one morning and he was already drunk and belligerent.
I feel bad for his old mother, because I think he is going to spunk away all the money we gave him, so she will end up losing her house.

It wouldn't matter if he did. The apartment is a guarantee of our deposit. If he can't pay us back, the apartment will be taken from his mother and sold. That's why I feel bad for her.
