In 1994 I got busted stealing pumpkins and smashing them on the road. I did a criminal background check and that misdemeanor appeared on my record. I turned my info over to my school for a visa run and the government denied me. The school is trying to petition on my behalf since it happened when I was 21 (almost 16 years ago). I think it also falls into the "prank" category and not really the "criminal". Anybody out there get into a school with a minor criminal offense? |

What was the charge?
Theft?
Public Nusance?
Destruction of Private Property?
How bad does the charge look?
Did you go to court, plea out, nolo or skip court? |

It's also part of the grand scheme to keep Gallagher off of Korean soil, so ya can't fault them too much for that... but I feel your pain. |

Misdemeanor theft. Recieved a ticket. Went to court. Paid a fine. Slap on the wrist. Walked away. The thing I find silly is that I have already been employed in Korea for 6 years before I had to submit a criminal background check. I never got into any trouble while in Korea. |

That's feakin' funny. I just saw an old Gallagher on comedy central last week. It was more like "flyin' pumpkins" out of my friends car. They landed on various front porches and store fronts. No 'real' damage. Just messy. Not like they were bowling balls or something like that. |

It was funny? You got Gallagher beats hands down then..... you can always fall back on that if you have to....
How were you able to avoid this problem so long after the initial crackdown on E2's.... I had left my hagwon at the worst possible time, a day before they announced the needed CBC apostille..... I thought they were needed after a certain time even if renewing with the same school.
Live and learn I suppose..... my biggest sin was taking my family's advice on what field to go into in the first place. |

With all the suspicions, xenophobia, media hysteria it's only gonna get worse. That is I believe that the requirements in other (all?) areas are gonna be more stringent. There are times I miss the days of the mid 90's here. |

I thought that, at least in the USA, misdemeanors and felonies didn't appear on your records after 7 years.
That is to say after 7 years a person has a clean record, as long as you don't do anything else.
It really sucks to hear that this is not the case. |

you can apply to have your record expunged and then get a new crc issued that is clean. |

Get a CRC from another county/city. Should come up clean. |

This thinking would make no sense. If you commit a crime and are under the age of 18, it will remain hidden. But if you think these things will leave your record after seven years your wrong. Most felons get out of jail and are on probation for seven years. A felony will stay on your record for life.
Depending on the misdemeanors, you may be able to get it taken off. But if you don't it will still stay for life. Trafic tickets and bankrupcy have time limits. |

I found out that you can have it "expunged" from your record after 3 years. If you have completed all the necessary requirements (probation, classes, pay fine, etc). My problem now is that it will cost a pretty penny and take time. Both of which I have little of since school starts up again on March 1st and I'm currently broke.
My next option is to get a criminal check from a state I used to live in and never got in trouble. I'm efforting that as we speak. |

If your CBC was submitted and denied, then Korean Immigration has your criminal background check on file now. Getting a new one will not help, since they will still look at your first CBC.
If you get your record expunged and can get a clean CBC from the same source along with a letter stating that your new clean CBC supercedes the old one, you might have a chance of getting Immi to overlook the one they have on file. But, they could still deny you a visa.
Sorry, but Korea is probably out for you now.
Try a different country.
Before you apply for a visa, make sure your CBC is clean. If you can get your record expunged, do it BEFORE you apply. Apply with a clean CBC. |
