I was under the impression that we couldn't apply for a D-10 visa until our visa expired. Yesterday I contacted immigration and they said we need to apply 'before' the end of the contract.
Can anyone clarify this please?

End of contract. Typically most E-2 holders have a few weeks added onto the end of their visa for about 13 months (1 year contract + 1 month to wrap up things) So when you apply for a D-10 bring a copy of your contract to show your are finished working.
Basically the D-10 puts your visa on holding. You do not want your Visa/ARC to expire. You just have to show your work is done and you will be looking for another job. You can not work on a D-10.
If your work/contact is not finished, the a Letter of Release will be needed. |

You need to apply before your ARC expires.
For those on an un-extended E2 that would give you a couple weeks after your contracts ends.
For those who have extended their E2s the contract end date and E2 expiry date are usually the same - hence the need to change status before the end of the contract.
