|
|
My previous hagwon offered pension but I declined. My current public school enrolled me in pension. I know when I leave the country I can get a lump sum at the airport. Anyway a new job offered to transfer my current visa but said they don't pay pension. They only pay for Korean teachers. I specifically asked for it because extra money is always nice The manager said that he couldn't pay my pension and not other foreign teachers. My main question is will i be able to get the pension from my public school with no problem when I leave Korea in a year or two? Also, since I've signed the contract can I get the new school to pay my pension? |

WHat kind of new job?
Still, by law you are to pay into pension. Does not matter if you a are Korean or other. All workers (legal) are to be enrolled in NPS. Sounds like the new place is being cheap and giving wrong information. Unless it is a private University, I guessing not.
In the end, what is likely going to happen is the place is going to say they do not pay pension. Forget to tell you that it is ALL your responsibility FOR YOU TO PAY. |

If it is a small school, it could be that they are not required to pay into it.
I think it's 3 f/t employees, I can't remember. |

Wrong, that's an old law. Now it's all workplaces. Check the NPS website. |

Plus health care. The two must be paid and registered together. Not legal to not offer both. |

You're intended new school has already revealed its intentions to you. Why buy a year of fighting when you haven't yet begun. Best to move on.
You haven't started yet at the new school and it sounds like you have time to find a different school than the one you've signed with. You should look for another new job that offers both Pension and Health Insurance - check the contract and talk to other foreign teachers there before you sign, to be safe.
If you can find a better job with Pension and Health Ins, take it.
You can tell the school that doesn't offer Pension that as an employee they are required to enroll you (each paying half) in both the National Pension and National Health Ins. If they insist that you are an Independent contractor (but it's not stated in your contract), you can state that you did not agree to be an IC. Either way you should treat the contract as void - they are either breaking the law or the contract or both.
If your contract does state that you will be an IC, and you didn't notice or care, then you could be a legal IC. So, just be honest. Admit that you didn't notice, tell them you don't want to be an IC and that you won't be coming. Of course they could sue you, but they won't.
As to your original question: Yes, you will be able to collect your pension paid in previously, even if you don't pay at the new school. Are you happy with no Pension and no Health Ins?
However, the Pension office may notice that you're still in Korea, working and not paying, so they may come after you and your new school. |
