Sold car to another expat...promised me he would register it soon, i left Korea then ..now 5 years later and many fines, no taxes paid...still not registered...I am in the USA but would like to return to Korea.., but found that the DA is looking to arrest ME for his mounting tickets etc..,.anyone know of a way to get help? |

I believe that when you come to sell a car - either you or the new person must hand over a form with your 'stamp' on it, basically saying that you've agreed to the sale AND paid off any fines due...
I guess they tried to register it but couldn't - was there any way for them to re-contact you?
Do you remember their name? Alien details of the person?
I think you'll find this problem lies squarely at your door.......
Maybe contact Seoul foreigner helpline and give them a call - BEFORE you come to Korea..... |

I have heard that if you can show that you were out of the country at the time the fines were incurred they won't persue you, however I am not suggesting that you rely on this.
In hindsight you should have accompanied the person to the government office and transferred the registration with them. No help to you but hopefully helpful to others.
You could call Seoul Global Centres legal service try http://global.seoul.go.kr/ as suggested from outside Korea but in all honesty I think its time you consider elsewhere. Coming back to Korea may not be possible. |

I agree with what both of the above posters have said.
I drive a car here. As far as I know, both parties have to be present to transfer ownership of the car. I know that I had to go with the guy I bought my car off to the government and the immigration offices to get the ownership transferred into my name.
I'm sure that the person who got the car off you has probably be enjoying the sweet deal of not having to pay taxes or insurance, but if that person is not still here than the car is probably being passed around among foreigners who don't mind taking the risk of driving an uninsured car.
Yes, contact the Global help center and see if you have any options, but I think you are likely not going to find yourself in a very good spot because you essentially gave your car to the other guy still in your name. |

I'd hate to be driving that car when the police stop it!
I'm pretty sure driving an untaxed vehicle is an offense, and if it doesn't have insurance either someone will be in some very warm water.
Of course the police don't have to stop it, having an accident is almost inevitable in Korea, one way or the other, karma will catch them. |

Both parties don't always need to be present if the proper forms have been filled out beforehand (trust me, I just sold a car). But, of course, if you're selling to a particular instead of a used car salesman, the wise thing is to be present (rule of thumb: many Koreans and foreigners are not as honest as you).
My friend was in a similar situation many years ago when he sold his motorcycle to a shop. The cops called him after he had left and returned to Korea, telling him they had found his bike and were threatening to fine him for not having paid taxes, tickets, etc. He gave them the shop's business card and he never heard about it again.
So, if you remember the person's name, you must contact the police and give it to them. |

The problem lies squarely at her door? Are you kidding? She most probably didn't leave the country immediately. If the guy she sold the car to really wanted to register it, he would have found a way to contact her. It's not that difficult. My guess is he never went to the DMV.

It's exactly why they have CCTV cameras on many roads and highways. Nowadays, the cops are setting up roadblocks because this sort of thing has become a huge problem. People who drive unregistered cars drive recklessly and cause accidents, some of which are deadly. |

Either way, they left their future in someone else hands.
I'd rather not do that!
A car is not like a cat/dog, that you can just 'give away' there are rules to follow.
As an adult it is best to find these rules out before hand and to follow them.
Not always easy in a foreign land TBF! |

There's probably more to the story. What if the guy told her he would register it himself, talking as if he knew what he was doing to gain her trust? What if he was an acquaintance? In North America, the seller doesn't need to be present to register a car. So, the only thing she would be guilty of is trusting an acquaintance and and assuming the rules are the same here. Those are mistakes that are easily made.
Ultimately, the responsibility lies with the new owner. The contract was completed when he paid for it, regardless of whether it was re-registered or not. Moreover, he is the one who drove it while knowing full well that taxes hadn't been paid and that the insurance had lapsed. Had he been honest he would have kept it parked somewhere until he was able to sort things out. |

Sound advice here to the OP - come to Korea 12ax7 will act as your lawyer
Maybe since you feel so wronged by the OPs situation you could PM her and take up her case for her in Korea?
That would be a nice thing to do!

Sold my car and de-registered it without the owner present. I needed certain things from him, such as proof of insurance, etc. to complete paperwork. The gu office had no issues. |
