Hello! I would appreciate some feedback on this contract. I very new to all of this so I sincerely value your opinions. Thank you!




EMPLOYMENT CONTRACT

This agreement made and entered into in this,
between , herein after referred to as �Employer� and , herein after referred to as �Teacher�.

WHEREAS, Employer desires to employ Teacher and Teacher desires employment at the ________ , Seoul, Korea it is herein agreed as follows:

Period of Employment: One Full Year

From , 2013 to , 2014

JOB DESCRIPTION:

Working Hours

Teacher�s daily working hours including prep time shall consist of 9:30 am to 6:30 pm, five (5) calendar days per week, Monday through Friday. The teacher is expected to complete 30.5 hours of in-class teaching each week. Any teaching hours worked beyond the 30.5 hour work week shall be deemed over time and paid additionally at monthly salary rate.

Responsibilities

Teacher�s responsibilities shall include but not be limited to class preparation, creating worksheets, teaching, lesson plan, grading homework, test sheet preparation, corrections, supervision of kids, writing student evaluation reports and training new teachers. Teacher is expected to be devoted to the Institute for lesson planning with co-teachers, student evaluations, reports, supervision of play in kindergarten break time, and maintenance of the student attendance.

In addition to the above mentioned, Teacher will participate in teacher seminars, open houses, annual events as scheduled by Employer.
Employer will provide teacher with at least one week notice of schedule changes.

Duties:
Duties may include,
To give lessons according to the curriculum of the Institute,
To prepare teaching materials for each English class,
To assist with the development of teaching materials related to English language education,
To attend all teachers� meetings and workshops,
To interview new students for level testing,
To behave in a professional manner during class and when socializing with students outside of class,
To be sensitive to the cultural background of Korean students and their expectations of teachers, and
To behave according to company policy under the terms of said contract
The Teacher�s duties and responsibilities, as well as the academic programs, may be modified, from time to time, after agreement by both the Teacher and the Institute.

Behavior

Teacher shall conduct themselves in a professional manner at all times. Teacher shall obey all laws and ordinances of Korean Law and company policy. Teacher is to be properly dressed(Semi dress up, No casual) at all times during working hours. The institution does not allow extreme hair styles, the wearing of revealing clothes such as shorts and excessive make up. Conducting classes while under the influence of alcohol or controlled substance is prohibited and means for immediate dismissal. The use of profanity at any time while at the institute are grounds for immediate dismissal.

Dual Employment Prohibition:
Teacher, after signing the agreement and receiving a work visa, can only legally work for an Institute designated by the Institute. The Teacher shall face legal consequences which may include a fine and possible deportation if found employed at any other institutes, companies, or individuals without the written consent of the Institute and the Korean Immigration Office.

Performance Evaluations:
Teacher may be evaluated monthly by supervisor or director. The Institute has the right to determine if a performance appraisal is needed more frequently. The review is designed to provide both the Teacher and supervisors with time to discuss his/her strengths, weaknesses, career objectives and other concerns.
Teacher is in charge of one class of Kindergarten and one class of Elementary in daily schedule. Through the monthly evaluation, 30,000 KRW additional incentive per increase student numbers of class in charge and minus 30,000 KRW of negative incentive per decrease student numbers of class in charge will be applied every month.

Confidentiality:
Teacher hereby agrees not disclose any information related to any teaching materials, or any information related to the academic program, whether verbally or written, to individuals or corporate entities.
All teaching materials including textbooks and teaching resources given to the Teacher are property of the Institute. The Teacher must not take out or use these materials for any purpose but for teaching at the Institute.

Monthly Salary

Employer will pay the Teacher a total monthly base salary of
2.1 milion Korean won. The monthly salary is based on the monthly teaching session. Teacher�s salary shall be paid on the 10th of the month for employment services provided. In the event the 10th shall fall on a weekend/holiday, salaries will be paid on the next business day. Korean income taxes(3%), Residence taxes(0.3%), 50% of Medical Insurance, and Korean National Pension deductions will be withheld.
In the event of Teacher Training period(1 or 2 days) 50,000 KRW per day will be paid for the training days. When a teacher has not worked a full month, the salary for that month shall be paid on a pro rated daily basis.


Pension Plan
In accordance with Korean Law, all foreign workers employed by
Korean business shall pay into the Korean National Pension plan at a rate stipulated by the Korean National Pension Law deducted from monthly earnings. Where the Pension Act of the Employee�s home country provides the benefit corresponding to the lump-sum refund of the National Pension Plan, the lump-sum refund of this plan will be paid to the Employee, according to Korean Law. Pension benefit is effective from the date of Alien card successfully issued in Korea.

Severance Pay:
Upon completion of this 12-month contract with Employer, Teacher will be paid severance pay(average amount of last three months salary), according to Korean Law. Korean severance tax(6%) will be withheld. This payment is made at the time this contract is complete, including any classes subsequent to that covered under this agreement.

Tardiness:
Teachers late for work shall have their wages reduced accordingly. In the event the teacher is late for 20 or more minutes teacher shall be penalized at a rate of an hour salary. In the event the teacher is late 3 times a written reprimand shall be issued.

Housing:
will provide furnished living accommodations.
I. Single housing or apartment will be supplied by the institute.
II. The apartment will be furnished with following: bed, cooking stove, refrigerator, hot & cold running water for bathing, a western style toilet, air conditioner, and washing machine. (Meals, utilities, telephone and incidental expenses are the sole responsibility of the Employee)
Teacher is responsible for any and all utility bills such as gas, water, electricity, monthly maintenance and internet access.

In the event damages are due to the negligence of the teacher, teacher shall be responsible for the cost of repairs. Any and all furnishing provided by the institute will remain the property of the institute. Upon completion of the teachers contract, all items provided must be accounted for. Missing or damaged items will be charged to the teacher. In the event teacher�s employment is terminated prior to the completion of said contract, teacher shall have 24 hours to vacate his/her apartment.

Holidays:
Teacher is entitled to all Korean national holidays.

Vacation: Teacher is entitled to 10 paid vacation days per year. During The Vacation period 50% of salary will be calculated and paid to the Employee. Vacation days will be divided into 5 days in the summer and winter. The vacation days will be determined by the employer. Employees can not ask determined vocation schedule changes in any personal reason.

Sick days: In the event the teacher is found to have falsely claimed illness, the teacher will be immediately dismissed and double the wages will be deducted from the teacher�s monthly salary. If teacher is absent for illness teacher must submit doctor�s note to prove illness and the absent day is not paid.

Transportation:
Employer will provide a one way economy class ticket to teacher from Teacher�s location to Korea and this ticket cost will be deducted in first month salary of the teacher. Upon completion of the term of 12 months contract, Employer will reimburse the full amount of one way economy class ticket from Teacher�s location to Korea in last month salary.
Upon completion of the term of 12 months contract, Employer will provide a one way economy class ticket for Teacher�s return flight home. The destination will be the closest major airport to the Teacher�s home.

If Teacher is hired within Korea, the cost for visa trip shall be reimbursed in last month salary upon contract completion to the employee.

Medical Checks: (As required by Korean Immigration Law)
The Teacher agrees and is otherwise aware that Korean Immigration requires all teachers to conduct a brief medical check at a designated clinic upon arrival. The Teacher is aware that failing to meet the Korean Immigration E2 medical check requirements will result in a cancelled work visa. Teacher hereby agrees to take full responsibility for failing to pass the medical check understands that the school bares no responsibility for covering the costs of returning the Teacher to their country of citizenship.

Termination:
The Employer has the right to immediately terminate Teacher�s employment for the below listed reasons.
Teacher displays blatant misconduct by breeching any of the terms set forth here in this agreement:
Arriving to work under the influence of alcohol or controlled substance;
Sexual misconduct towards a student;
Two consecutive days of unexcused absence from work;
Teacher�s health prohibits teacher from fully performing his/her duties either physically or mentally;
Engaging in any illegal activities or criminal behavior;
Teacher displays any act of insubordination;

Additional causes for termination:
Teacher has received two reprimands within a 60 day period;
Habitual tardiness; Direct or indirect influence of loosing students from school;

In the event the Teacher wishes to voluntarily terminate his/her employment, 60 days notice must be given in writing. No severance pay or airfare shall be given in this event.
In the event of employee�s failure of completion of the term of contract the recruiting fee paid by employer to the recruiting company should be paid by Teacher for the employment of new employee.

Sole and Entire agreement:

This agreement shall be the sole and entire agreement between the two parties named above. Both parties acknowledge all the terms set forth in said agreement. Agreement is binding between said parties. This agreement shall be in effect upon execution by both parties.

IN WITNESS WHEREOF, The Employer and the Teacher have each duly executed this Agreement on the dates set forth below their respective signatures.

HOUSING CONTRACT


This agreement between _______ and is concerned with housing for teachers employed by ________. Teachers who choose to provide their own accommodations will be given a 300,000 won monthly housing allowance. Teachers choosing to live in housing provided by school will be required to leave a 500,000 won deposit with school to cover any damage to the apartment, cleaning bills or unpaid utility bills left by the teacher when the apartment is vacated. A 50,000 won deduction will be made should the apartment need additional cleaning. The amount of housing deposit will be deducted in second month salary of the teacher. Teacher gets the remaining amount of the deposit back once their contract is completed.

The apartment will be single for one Teacher. The apartment must be kept clean and the appliances maintained in good working order. Employees should report malfunctioning appliances or apartment damage to their supervisor as soon as possible. The apartment will be furnished with the following: bed, cooking stove, refrigerator, hot & cold running water for bathing, a western style toilet, air conditioner, and washing machine. (Meals, utilities, telephone and incidental expenses are the sole responsibility of the Teacher) Teacher will be responsible for costs resulting from willful damage or neglect of said furniture and appliances as provided by Employer.

If, for any reason, the Teacher ceases to be employed by school, the Teacher will be given 24 hours in which to vacate the apartment. The Teacher must set up an appointment with the manager of teachers to inspect the apartment prior to moving out, in order to establish the condition of the apartment. The information from this inspection will be used when calculating the amount of the housing deposit to be returned to the teacher. If the apartment requires cleaning or repair, these costs will be deducted from the Teacher's deposit.

Why is this not going under the sticky contract section? I'm not sure what I'm doing wrong Embarassed Help! Could someone please offer me some advice on how to post. I feel like an idiot. Bleh.

Run Bro! You can't control if the students quit and this could potentially make a horrible situation.

30.5 hours? Odd. Anyway, what is the hour of teaching defined as? Usuaully, it's 50 minutes. Some places may have 45 minutes, depending on the age of the students.

None of their business what you do outside of class. At any rate, I'd strongly suggest that you don't socialize with students. There are approximately fifty million people in South Korea. Go meet someone who's not a student at your school. I also strongly suggest that you don't socialize with the Korean teachers or staff at your school either. Again, there are approximatley fifty million people in South Korea. Go meet someone who doesn't have power over you at work. And make no mistake, all the Korean staff are above you in the work hierarchy.

Do they mean the 10th of the month for work performed the previous month (which they probably do mean) or do they mean that they will pay you on the 10th of the month for work commencing on the 11th of the previous month all the way through and including the 10th of the current month (which they probably do not mean). Look, there is simply no excuse for a small outfit like a hagweon to not pay you on the last day of the month for all monies earned during that month.

I keep forgetting if foreigners are supposed to pay the residence tax. But one thing I never forget is to check to ensure two things: the boss has actually enrolled you in those programs and that he's turning over all the deductions to the required recipients.

No. No, they won't. The boss can, of course, dismiss you for falsely stating that you were ill. What he can not do is take from you more money than the value of the sick day. In other words, you lied about one day, he can dock you one day's pay because you didn't work that day and you didn't have a valid excuse to miss that day.

So the above is basically irrelevant because for any an all sick days, you need a doctor's note anyway.

I think that's about right. Of course, there are laws regarding timeliness of dismissal and law trumps contract if the law is in your favor.

This one I agree with 100%. Korea's public transportation system is excellent. There's no reason that you can't manage to make it to work on time every day. I've seen a fair number of NETs who can't manage that because they're too busy partying every night of the week. Save that noise for Friday and Saturday if you can't get up on time the next day.

The apartment will be single for one Teacher. The apartment must be kept clean and the appliances maintained in good working order. Employees should report malfunctioning appliances or apartment damage to their supervisor as soon as possible. The apartment will be furnished with the following: bed, cooking stove, refrigerator, hot & cold running water for bathing, a western style toilet, air conditioner, and washing machine. (Meals, utilities, telephone and incidental expenses are the sole responsibility of the Teacher) Teacher will be responsible for costs resulting from willful damage or neglect of said furniture and appliances as provided by Employer.

If, for any reason, the Teacher ceases to be employed by school, the Teacher will be given 24 hours in which to vacate the apartment. The Teacher must set up an appointment with the manager of teachers to inspect the apartment prior to moving out, in order to establish the condition of the apartment. The information from this inspection will be used when calculating the amount of the housing deposit to be returned to the teacher. If the apartment requires cleaning or repair, these costs will be deducted from the Teacher's deposit.


I don't think so. The place likely won't be clean when you move in unless it's brand-new.
