LoR necessity when changing visa type

I am desiring to quit my job for multiple reasons.
They were misleading about the job duties, I am pretty sure multiple things in the contract are illegal, and I know for certain they have done other illegal things. I of course also cannot stand the owner. I also have an opportunity for a better position.

The problem is, I have only been there 3.5 months. My relationship with them is okay, but I imagine to have any chance of a LoR I'd have to give them the 2 month notice nonsense.

I know I need the LoR to transfer my visa. But do I need the LoR if I am changing my visa type? For example, if I change to E-7 to work in an administrative role instead of a teaching role... I have the degree and experience in my home country, so I don't see the problem getting a E-7 in general, but do I have to wait for my contract to expire even if I am changing visa types if I quit my job and notified immigration to cancel the current visa?

Or must I just do what I can to make sure I get the LoR (2 months notice)?

Can you temper that with some more advice or reason on why he or she should?

To the OP, even with a visa change you will need the LOR.

Even giving notice does not mean you will get the LOR. Unless it is stated in the contract an employer is not obligated to give you an LOR. Quitting jobs is never an easy thing. You could give notice and be up for negotiation and you could still find your self being screwed around. Hmm. Thinking about it Nolos just said very succinctly on what you will need to do.

Even the E-7 is not a sure thing, you still have to find a sponsor who is willing to go to immigration that they need you.

Can we get details on the illegal things the school has done. If so maybe you can get the labor board to give you permission to change jobs.

Just explain to your boss that teaching doesn't suit you, that you want to change to a different kind of work, that you intend to give two months' notice as required and that you would appreciate getting a letter of release. Most hogwans will be reasonable and give the LOR, even if the govermnent schools won't. If your only other option is to wait out your contract back home, you should at least try for the LOR.
