Hypothetical question: If I were to leave my current job (at it less than one month), but wanted to get a new job in Korea, what would my options be? As I see it, these would be my options:
1) Ask for a Letter of Release, which would allow me to transfer my visa to a new school or to receive a D-10
2) Not get the Letter of Release. I already have another apostilled degree copy, and I've heard that a new CBC isn't needed as long as I have not been outside of Korea for 3 plus months. In this case, couldn't I just leave Korea for a short period of time (like 2 weeks) in order to have the E-2 cancelled, and then be eligible for a new E-2, since I already have my apostilled degree? I really want to avoid getting a new CBC. But I've also heard that the school may not cancel the visa?
My contract has a 30 day termination by either party clause, so I'm assuming if I provide 30 day notice, that my employer would cancel the visa, which would allow me to just submit my docs to a new school and start work again relatively soon? I will have to pay back the flight, which is fine and reasonable. I basically just have a much better job offer with a higher salary at the old company that I used to work for and would just like to do that rather than spending an uninspired time at my current place. Also heard that my current hagwon does not honor the vacation policy, which is a large reason why I even took the job to begin with. Highly doubt I'll get a LoR mainly beause I haven't been at the school long.
Any insight would be great. |

GET a LOR and get a new job.
Don't get a LOR then look at China, Thailand, etc. until Oct of next year.

Thanks ttompatz. But, what would happen if I don't get a LoR but wanted a new job in Korea? Couldn't I just turn in my ARC (which I don't even have yet) at Immigration at the airport or have Immigration stamp a "cancel" on my E2 visa to get my visa cancelled, which would allow me to be eligible for a new visa? Granted, I would have to start with new documents, but I already have my apostilled degree with me here. I've also heard that my CBC would still be valid as long as I return to Korea within 3 months (which I would). Is any of what I just wrote correct?
The director of the school is actually quite decent, however, I'm well aware that all of that could change the minute I submit a resignation, so I'm trying to get a clearer picture of all of my options first. Thanks. |

Current policy (under the current government) has reverted to what it was pre-2006.
If you quit and do not have a LOR then you have to wait until your contract period expires before they will allow a new E2 application regardless of whether or not your visa was canceled, voided or expired.
The ONLY exception would be to win in a labor tribunal for breaches of labor law or unpaid wages (documented and complaint on file at labor).

Just a follow up question - if I used a recruiter, would I negotiate a LoR with this recruiter or with my hagwon boss? I hear the schools can get a replacement candidate for free from the recruiter if a teacher leaves prior to 3 months. Is that true? I've been at the job less than three months and have a 30 day notice required if I quit. I know that I have to pay airfare back, but if my boss doesn't want to give me a LoR, what could I do to try to get one? I want do this soon, rather than wait around while I'm miserable at the job. |

Most recruiters will not refund the placement money once it has been paid. For the first month or two they will usually offer to help find a replacement for the teacher who didn't work out. However, schools, like teachers, use more than one recruiter, so even then it may be that they need to hire a new teacher from a different recruiter and pay another fee.
In your case, it's probably beyond the time period where the recruiter will find a replacement for you with no fee. They may offer a discounted fee, but likely not. If your boss has to pay to find a new teacher, he may feel that financial loss too keenly to give you an LOR. You need to soften the blow.
Think about this a lot before you start going down the road to resignation. Are you sure you want to leave this job - even if it means you have no chance of continuing to work in Korea till your visa expires?
When you start talking about quitting or leaving early, you can make your boss angry. Your life could be more difficult. You could even be fired on the spot - all of these things come with no LOR. Start by saying how you're not happy and you're not sure you can keep going. See how your boss reacts.
To get an LOR, you should plan on staying a little longer. If you choose to give notice, you can offer to give two months notice and help to find your own replacement. See how this goes. Don't offer everything when you approach your boss, save something back for negotiations.
Eventually, you might have to buy your LOR by offering to pay the recruitement fee. If you stay 6 months you won't have to pay back your airfare - if you have a standard agreement - so you will have more to trade and less to lose.
Whatever you do, think it out carefully first. Play your cards close to the vest. You will set the tone for the events to follow when you start this process. |
