Hey!
I have a bit of a complex story going on so would appreciate some advice!
My wife and I currently work with EPIK and finish at the end of February. I shall be moving onto a University and my wife will most likely stay at home and take care of our son...
1. I will be transferring my E-2 visa over to the new job.
2. My wife will be transferring from E-2 to F3 (spousal) as will my son.
- When can I transfer my visa over to the new job? Does it have to be once my contract has finished?
- How does my wife go about transferring over to a F3 with my son?
The reason I ask is that we will be on vacation from Feb 12th to the 24th and then my wife will be leaving again on the 26th for 3 weeks before returning to Korea.
Can I transfer my E-2 at the end of Feb and then my wife transfer hers to an F3 when she gets back mid March?

Your wife can get her visa when she gets back. There is no time limit on getting that done.
Normally you can submit your paperwork for the new visa (or rather to update your ARC) 2 weeks before your current contract finishes. It's possible that you could do it sooner but immigration might tell you to wait. It may take a while until you get an updated ARC but that's not a big issue because as soon as your hand in the paperwork, your online immigration file will be updated. As soon as your new contract starts (if it's after your current contract finishes) then you will be covered. If you go to the airport the immigration officer will see that everything is ok, even if your physical ARC shows an expired date.
If you want to transfer to the new job before the current contract finishes, i.e. you aren't going to finish the current contract, then you'll need a letter of release. |
