Hi there,

I have been searching google and have had no luck finding any decent info.

As the title suggests, I should be getting married this year and would like to return to the UK to work with my wife (to be). Does anyone know the process? I guess I have to start early so if anyone has any information on this matter, I'd really appreciate your input.

There is a rule about making at least 18,000 pounds.
You can find the info on the BBC site if you do a search.
But there were people who made more than that but had a problem since they were self-employed.

It is really bad.

Some people work in the EU for 3 months then move to the UK with no problem.

I have a property in the UK so accommodation wouldn't be a problem. I'm sure that finding a job above 18k would also be fairly easy. I just wonder if there are any other criteria that perhaps my girlfriend would need to meet.

What Brooks is referring to is the 'surinder singh route', basically you have greater rights to enter the UK as an EU citizen than you do as a British Citizen. Aren't the Tories great.

If you work full time in any EU country you can get a residency card for your wife and then after 3-6 months enter the UK. Your wife's employment is irrelevant, it must be you working full time for that three month period.

From what I have read 3 months does seem to be the minimum and you have to work at least 30 hours a week in the EU country you travel to first.

To enter the UK directly you need to prove you are earning at least 18600 GBP, if its just for wife, if you have children you need to earn progressively more for each child.

You can use savings and you said that you have a property, so that could be used to show you have enough savings. You would need 62000 GBP in savings just for your wife, although you can combine the amount from a lower paying job with savings to help push you over the threshold.

Note though that the savings must be held in cash on the day of the application.

They are trying every trick in the book, but there is no way to shut down the surinder singh route. It is enshrined in EU and British law and the other EU member states have no desire to abolish the right to free movement.

The only way for the UK govt. to shut it down would be to leave the EU.

Although they have as of this year included a new proviso, the new rules state that in order for family members to benefit from the Singh provisions, the British citizen must have transferred the ‘centre of their life’ to another member state.

What this means, no one knows, but unless you have property in Korea it is hard to see how they could argue that the 'centre' of your life had not moved to the EU country in question.

Also I forgot to mention that you could get a 6 month marriage visa for the UK and get the job and everything lined up during that time.

Although she might have to leave and come back.
