I recently signed a contract to work at an after school co stating in March. Although the after school co has my documents, I have not signed a contract with the public school yet. I am not sure what they have done with my documents, and they recently asked for my current address.

At the last minute I ended up getting a uni gig. How can I take the uni gig without getting sued by the after school company? What are the ramifications for doing so?

I assume you're in country. They can't sue you at all. If no money has changed hands (plane ticket etc.) so don't worry about that. They important thing is to get your documents back.

Go to the school. Say an emergency has happened and you have to return home. Tell them to give back your documents and then tell them that you are still interested and will re-apply from back at home in your home country in the next couple of months when the emergency is over. This way they save face.

If you go to them and say you found a better job they may give you a hard time to return your documents back to you.

If you didn't sign any contract then there is no problem. The after school boss will likely be upset and might not give you back your documents (in fact, he most likely will not). If you had signed the contract then you might have a problem if the employer had submitted an application for a visa issuance number. But no contract = no VIN application.

There are no legal ramifications. It's completely legal to do what you've done. It's actually very common as well.

So the only ramifications is that you might have to get another set of documents. If you already have a second set (which everyone SHOULD have before coming) then you're set.

I should clarify. As of right now the after school co only has copies of my documents. They do not have anything that I do not currently possess. I did sign a contract but it was only with the after school company. There is no physical location on the contract. I know that I would need to get a contract with the school and the principals signature to officially be working for the after school co. I’m guessing it’s not a problem , as they would not be able to apply for my vin without the public school contract.

Oh ok. So you have signed a 'sort of contact' and you haven't given any of you original documents, just copies?

If that is the case tell them now that you have a better job offer and you won't be continuing with the visa process with them.

I will put this in caps: YOU CAN'T AND WILL NOT BE SUED! If they threaten this laugh in their face.

And another heads up. They may ask you where the new job is. (This will be in caps as well). UNDER NO CIRCUMSTANCES TELL THEM WHERE YOU WILL BE WORKING !!!!!!!!!!

Reason is if they are bitter they will contact the other employer and say negative things about you that would be enough that you would not be offered the job.

Koreans are vindictive when they have lost face.

If they are persistent about where you will be working, you can keep the good relation and say that you will tell them after you start your new job.
