Hi all,

It looks like it's about time to hit the eject button on what has unfortunately become a flaming wreck of a marriage.

Can anyone with applicable experience recommend a divorce lawyer in Seoul or the surrounding suburbs?

Did you two think marriage was a game? A whimsical fairy tale? It's not, and it takes WORK to keep it afloat. You both are lazy and need to talk it out and you BOTH need to compromise. Unless there is physical abuse or a cheating spouse, there is no reason anyone should divorce.

Some details would help here.

Were you not the tool who posted a thread or two a while back asking the EXACT same question? Didn't your wife run off with your baby because you spent too much time on the internet and you called her a "psycho bitch"?

I'm coming to this late, but seeing as how there has been no recommendation posted here I would like to offer one, in case someone reading this thread in the future may need a divorce lawyer.

I'm an American lawyer working at small and large Korean law firms for almost 20 years; my practice area is corporate law and employment law (management side only), so I am in no way trolling for clients. A US-licensed lawyer really won't be much help in these circumstances, because we are not permitted by law to take money in exchange for legal advice (except if employed at a firm of Korean-admitted lawyers) and cannot represent a party before any agency of the Korean government. If you find yourself talking about divorce law with an American lawyer in a bar or restaurant and he tells you he "has somebody" who can help, be aware that you've probably just marked up your cost by about 20% as this person is going to claim a referral fee.

Instead of working through an American lawyer, what you want is a Korean-licensed lawyer with good English and familiarity with the practice area. I would like to recommend to readers here my former associate Ms. In-Kyu Hwang, who is a Korean-licensed attorney with 10 years experience, very strong English (we worked together for many corporate clients including companies like Apple, Volkswagen, and Marriott) and experience handling divorce matters for foreigners as well. Since she dropped out of the firm to have her son a few years ago, In-Kyu has been in solo practice keeping some of our former corporate clients and taking on the occasional divorce matter I send her. (I do not want a referral fee; she's my friend and I want her to be successful.)

Today we had lunch and she said she'd like to receive more divorce matters, because she thinks that market is underserved. I agree. So here it is: If you are a foreign resident of Seoul seeking a divorce, call my friend Ms. In-Kyu Hwang, Esq. at 010-9099-1476. Don't call her up just to bend her ear for free advice; make an appointment and visit her in her office. I have no idea whether she charges for an initial consult or not. She should. If you visit her for counseling please do be prepared to pay for her time because in private practice all we have to sell is our advice.

Yes, even thou the original thread was from 2013 sometime, thats more than enough time for the divorce to be finalized and her to have taken everything you own. I'd also like to know the outcome.

Get yer F5 before you split. Even if she's banging everything in site. Just smile, nod, and proceed until you get that F5. Not telling you to be a C@k old or anything like that. Just live seperately while still officially together until you get that F5.

If you are going to file for divorce, make sure you live in Seoul or move to Seoul. Don't file for divorce in some lame countryside court. The old traditional thinking prevails. Make sure whatever lawyer you get isn't a lazy SOB who doesn't do anything. Whatever you do, don't pay all upfornt and negotiate final fees based on results. I'm telling you this with certainty based on a friends experience going through the divorce. He would have gotten a better lawyer and negotated some of the payment based on result (or effort), then he would have done it in Seoul. In the countryside, his ex wife was a crazy screaming physco that would harass the court and scream at the judge. Unlike in the west where she would be put in jail for this, the court would listen to whoever yells the loudest as though that were justice. In Seoul, things will be more professional.

Last but not least, if you have your F5, do not - I REPEAT - do not let property be only in your wife's name. Even if you're F2 or F6 insist that both of your names are on the property you own. Even if the Gu, Dong, Gun, Shi or whatever office tells you isn't possible to put your name on it. DO NOT ACCEPT NO FOR AN ANSWER. Whoever yells the loudest and is the most persistent will eventually get their own way here. You must have your name on property so that after a divorce you have a chance. Otherwise, kiss it goodbye if it only has her name on it.

Better yet, if you're marriage is registed in America, Canada, or where ever, see if you can just divorce there. Take any kids with you too. Keeping the kids is a civil offence and not a criminal offence. Cops here won't do anything about it. Your ex might move to your country and seek joint country perhaps. If she does, get a court order watching for your kids passports at all airports and land borders. In our countries, it is kidnapping and your ex will most certaintly end up in a jail cell. But, in Korea, it is not.

Yes. I bought my apartment myself while on an E2 visa and registered in my name only at that time - so you can register property no matter your visa type.
