EMPLOYMENT CONTRACT
This contract is made by and between ________________ at
__________________ (hereinafter referred to as the Institute) and
____________ whose domicile is at _______________
(hereinafter referred to as the Instructor).
1. PURPOSE
The Instructor is hereby employed by the Institute. This contract
defines terms and conditions which the Instructor agrees to follow.
2. APPLICABILITY OF CONTRACT
Within the parameters of Korean Labor Law, disputes between the
Institute and the Instructor shall be settled according to the
stipulations set forth in this contract.
3. PERIOD OF EMPLOYMENT
The period of this contract is one year beginning from the Instructor's
first day of teaching. (From May 1st, 2015 to April 30th, 2016)
4. QUALIFICATIONS
The Instructor must be judged qualified to teach and be able to submit
all the necessary documents required by the hiring procedure of the
Institute.
5. DUTIES
The main duties of the Instructor shall consist of the following:
1) ESL Instructor in any and all phases of the curriculum of the
Institute.
2) Substituting, making up classes, performing open lectures, level
test and counselling.
3) Development of educational programs and materials.
4) Preparing class plans and materials.
5) Administrative duties related to classroom duties.
6) Attendance at faculty meetings and workshops.
7) Other activities related to the business of the Institute and its
holding company.
Special events held on Saturdays twice a year will be paid as overtime.
6. SCHEDULING
The Institute shall have the sole right to schedule classes for the
Instructor.
7. CONDITIONS OF EMPLOYMENT
1) When the Institute decides it to be necessary, the Institute may set
some rules on what to do or what not to do inside the Institute.
2) When performing ESL instruction, Instructors must wear professional
clothing: namely, dresses or dress pants for women, ties and dress
shirts for men. The clothes must be clean and show dignity of the
Instructor. Ripped pants, revealing clothes, and slippers are
not allowed.
3) The Instructor must follow the teaching method of the Institute and
is not allowed to teach by one's own teaching method.
4) The Instructor is requested to participate in all of the Institute's
events.
5) The Instructor must inform the Institute of any necessary changes in
classrooms or hours.
6) The Instructor is not allowed to perform ESL instruction outside the
designated classroom without prior approval from the Institute.
7) The Instructor must not make the information public that he/she
obtains at the Institute while working or after resigning.
8. MONTHLY WORKING HOURS
1) The Instructor normally be required to perform ESL instruction for
up to 8 hours a day (from 2 pm till 10 pm on Monday to Friday), and The number of regular teaching hours will be 30 hours a week.
2) When inevitable, the Institute may request the Instructor to perform
ESL instruction for more than the hours stipulated in clause 8-1 by
mutual agreement.
3) In the event that the number of teaching hours for any particular
month is below 120 hours, the Instructor shall be required to
achieve duties stipulated in clause 5-2,3,7.
9. INSTRUCTION FEE
1) The institute shall pay the instructor 2.1 Million Korean won per one month and it will be paid on the 8th of the following month.
2) The institute will pay the instructor at 20,000 Korean Won per hours for each additional overtime teaching hour stipulated in clause 8 - 2
3) The aforesaid instruction fee of the month shall be paid in Won on
the end of the month.
4) The hours spent for class preparation, workshops, or school events
will not be considered as part of teaching hours, therefore shall
not be paid for.
5) The instructor who successfully completes the one-year contract will
receive one month salary bonus.
10. TAX
From each monthly instruction fee, there shall be a deduction for 3.3 %
tax in accordance with the relative laws.
11. HOUSING
1) The Instructor shall use one studio of the living accommodation
provided by the Institute.
2) The Instructor is responsible for utility cost of the accommodation
such as electricity, water, gas, cable T.V. and telephone bill etc.
3) In the event that the Instructor does not choose to live in the
accommodation thus secured by the Institute, the institute will
provide a monthly housing allowance of 300,000 Won.
12. AIR FARE
1) The Instructor will receive the round ticket, if he/she complete one year contract.
The Instructor can choose either pre-paid tickets to Korea or reimbursement.
If the Instructor chooses the reimbursement, the Institute will pay the Instructor the cheapest airfare they can reserve.
The Instructor needs to pay the extra cost, if he/she takes more expansive flights than the Institute can reserve.
13. HOLIDAYS & VACATIONS
1) The Instructor shall observe the same national holidays(13-16days)
that are observed by the rest of the staff at the Institute.
2) The instructor will receive 10 days paid vacation, if the contract of one year can be done.
(5 days leave during the contract, The instructor can chose the dates
that this vacation can be used but can take no more than two
consecutive days of vacation at the time, and 3 days in summer and 2 days in winter leave according to the schedule of Institute.)
14. HEALTH INSURANCE & SICK LEAVE
1) The Institute will provide NHIC health insurance for the Instructor during the duration of this contract. The Institute and Instructor will each share 50% of the total cost of the health insurance. Upon request the Institute will provide the Instructor proof of health insurance coverage. .
2) Paid sick leave shall be granted, three days in the period of the
contract. In this case, proper medical documentation shall be
submitted to the Institute.
15. ABSENCE & TARDINESS
1) In the event that the Instructor must miss classes or be late with a
reason which the Institute finds acceptable, for example, an
emergency of sickness, the Instructor must inform the Institute at
least 12 hours in advance to allow the Institute to arrange
substitutes. A written statement with a rightful reason must be
submitted before or after the incident.
16. TERMINATION OF CONTRACT
The Institute reserves the right to terminate this contract with obligation to give a prior notice (30 days) in any of the following cases and to subject the Instructor to when:
1) The Instructor is found to be in breach of contract.
2) The Instructor is involved in a bad scandal that may tarnish the
reputation of the Institute.
3) Other circumstances for which the Instructor is responsible make it
undesirable for the Institute to continue employment.
4) Unexcused absence occurs more than twice in a two month period.
5) The Institute concludes that the Instructor cannot perform class
activities, or lacks the qualities necessary to be an effective
teacher.
6) The documents submitted to the Institute are proved to be
counterfeited.
In the event that the Instructor is dismissed, or in the event that the Instructor voluntarily resigns prior to the termination of the term of this agreement, the Institute will pay salary due to date of termination. The Institute will not pay the cost of return transportation. Further, the Institute will be entitled to withhold an amount less than or equivalent to, but not exceeding, the recruiting fee and the cost of airfare provided for travel to Korea and /or the cost of Japan trip.
17. GOVERNING LAWS AND JURISDICTION
This contract shall be interpreted according to the internal (domestic)
laws of the Republic of Korea. The competent court in Busan, Korea shall
have jurisdiction in regard to any disputes or claim arising out of or
in connection with this contract.
The parties here to have executed this contract in the two(2) original copies on the date stated at the end of this contract, with each party retaining one copy.
