I know the labour code states that workers must receive 1 hour of free time for an 8 hour work day. What I'm wondering is...can this 1 hour be spit up, or does it have to be 60 consecutive minutes?

My dumb employer has decided to split hour lunch hour into 2 parts. A 40 minute break to eat and later on we are adding 20 minutes to an already existing 10 prep time.

I don't mind too much really, but she seems to think of the 20 minute break as prep. It's clearly stated in the labor code that the 1 hour break is to be used freely. So I should be free to come an go during those 20 min as well, right?

Article 54 (Recess Hours) - (1) An employer shall allow a recess period of more than 30 minutes for every four working hours and more than one hour for every eight working hours during the working hours. (2) A recess period may be freely used by workers.

The hour can be split up. The hour is to be used freely, so prep time does not count. Make sure to get the hour you are actually working a nine hour day, so if you work from say 9-5 you don't get a full hour.
