My my academy's kindergarten is closing due to lack of students. They are keeping the afternoon classes open for now and have asked me to stay on. I'm going to lose my housing allowance and about 4-500k in salary/mth. They are going to pay 25/hr for the time I come in and continue paying my healthcare, pension(adjusted to new salary) and severance(also adjusted). Keeping those benefits is pretty unheard of for a PT job so I think it's probably a pretty good deal. They are allowing me to pick up a second PT job(as they should) and I'll now make more money(Yay!)
What I'm wondering is...should we write up a new contract? As long as I get paid in full, I'm fine. If we don't sign a new contract and there is some dispute when my contract is up...won't that just work in my favour as the totals of my original contract are higher(salary, pension contribution, severance).
Not trying to rip them off....just wondering if it's in my best interest to sign a new contract, and if so, why? |

What visa type are you here on? Yes you should have a different contract as the old one is likely completely different. I'd be more worried about immigration. |

No, you do NOT need a new contract but you should make an addendum to your current contract that stipulates the changes made by mutual consent and add it to the current contract.
One of the clauses (like clause 1 or 2) should state that it is an addendum to the current contract (give particulars like parties, dates), makes changes to the current contract by mutual consent and the changes supersede the current contract.
Then each change should be in a separate clause.
Signed, witnessed, sealed (school seal) and 2 copies each being identical and equal.

I have another question, however. When I came to work today my boss said that she miscalculated and instead of making almost 1.8 I will be making 1.55. That's a pretty big hit to take. I've already accepted a second job for less than I wanted, but the location and hours were good so I took it. If I knew they were going to pull this on me I wouldn't have taken the second job, but held out for one that paid better.
I had two meetings with my employer stating what my salary would be and what benefits I would receive(not in writing, other than a post it note) yet they are changing it. Is there anything I can do since I am no longer happy with what they are offering...we still haven't made any changes to the original contract.
If my only options are to either accept or quit(hoping they would give an LOR) then it really shows how immigration is very much on the side of the employer. They are changing the terms and conditions of the contract and there's nothing I can do? |
