The report documents hakwon employers' failure to advise employees of, or post, the South Korean government's "Summary of Labor Standards Act of Korea" in their hakwons effectively denying teachers knowledge of their legal rights under Korean labor law. Advising employees of or posting of this document is required for employers having five or more employees ( see Chapter I, Article 10 ). An employer must keep workers informed of the essence of this Act and the Rules of Employment by posting or keeping them at each work place at all times ( see Chapter I, Article 13 ). The information contained in the "Summary of Labor Standards Act of Korea" stipulates required conduct, law, and penal provisions applicable to South Korea.
The "Act" sets forth the rights of foreign employees. The act also covers topics including employment agencies, employment contracts, medical, rules of employment, certificate of employment, discrimination, threats, physical assault, and dismissal from employment without notice. The maximum penalty to an employer for violation is 30,000,000 won, or five years imprisonment.
