|
|
Last summer a taxi came into my lane and tagged my rear tire on my motorcycle.
I broke a rib, sprained an ankle and a wrist, tore up my knee, cuts and bruises all over my right side.
It was deemed by the police officer in charge to be 100% the taxi's fault.
The taxi company has a team who's sole duty is to settle accident claims. The next day they offered me 450,000won as 'pain money'. They would also repair my bike (250R) and cover any hospital bills to that point.
I turned down the offer and instead proceeded with medical treatment. I took full advantage. I went to PT (Physical Therapy) almost every weekday for two months. My plan was to settle when I became completely healed. However every week the taxi's insurance team would phone telling me to settle, very annoying.
Before settling a went to two privately owned insurance help centers. They reviewed my case (free of charge) and told me that I could also ask for transportation money and damaged clothes money. The taxi's insurance company told me several times that I couldn't, damn liars.
I settled two weeks ago for about 600,000won included in that is transportation and clothes money. They also paid my all my medical fees which I'm guessing would be nearing 500,000won and they replaced the fairings on my motorcycle which cost about 700,000won.
If you are in a simular situation don't believe a single word that the insurance company says. Go to the an insurance help center to find out what you should ask for.

This doesn't sound any different than anywhere else in the world. Of course the other guy's insurance company wants to save money and not pay as much as they should. They're not going to offer you MORE money than they have to |

another thing i've recently heard - to add to the list of things to NOT do when you're in a scrape with a cab (or bus) - no matter how small the guy is, and no matter how justified you are, don't beat the crap out of him.
to add to the poorly-thought out idea of "blood money" i've heard it reported on the-site-who-can-not-be-named and from AFN that in any scrape with a cab/bus driver it's an automatic (edit-not 60, but 20) 20,000,000 won fine for anyone who gets physical with them, regardless of who started it.
and if i'm passing on wrong information someone please correct me.
just play possum, call the police and an ambulance, act hurt and get your money. do what a nancy-boy soccer player would do in the last part of a losing game. |

Actually, I probably would have clocked him, but he was wearing the thickest glasses I've ever seen. Which explains a few things. I was taught to never hit a guy with glasses.
The doctor told me 90% of crashes like mine end in death. I don't believe that figure, but I consider myself lucky.

Every medium sized city should have a few. The labour office provided me with a map.
The insurance help centers will represent you. They didn't want to take my case because the pay out would have been too small. But they still helped me out (free of charge), by telling what I should ask the insurance company for.
The funny thing was that they were very hesitant. They feared that the taxi's insurance company would get angry at them. They asked me to not tell them where I found out my information.

Excellent tip mattman, and glad you came out of this OK.
I guess you need to speak pretty fluent korean to get through all this right? One more incentive to learn it. |

Basic Korean is a must.
I had to prove my side of the story to the police officer, communicate with the insurance guy, and talk to those insurance help center folks all in Korean.
Speaking the language does reduce the stress load.

I'm surprised they didn't find you at fault by default for being a foreigner.
Kudos to you for fighting for what you deserved. |

If I didn't have a motorcycle license I would have been at fault.
***If you have a motorcycle larger than a 125cc get a motorcycle license or get off the road. If you get in an accident you would be at fault.***

I would go further and suggest the one never accepts ANY offer an insurance company makes... they will always lowball you. Make an offer for THEM to accept.
A friend, back in the day, got really messed up by a bus. They lowballed her with 5 million, but as soon as she mentioned the word "lawyer" and "court", they settled for 50mill. After talking to a lawyer before leaving Korea, she found out she would have gotten around 100mill had she gone to court. |

hey, My friend got accident same as your case, he was hit by a car on his way to school, and the car owner sent an insurance guy to hospital to met my husband, and say they will bear the hospital bill ( that 1,5 month ago). And today, he check with the insurance company, they said they will pay the hospital bill 90% ( so far the hospital do not send/give any bill except those med bills that he paid 2 times ), because my friend was driving in the sidewalk, infact he was driving in the road not side walk. and his outpatient will be paid 8000 won ( enought for paying the taxi fare) while not compensate on his time spend on the hospital threatment. He rode on city daelim scooter( i guess 100 cc ) . he do not have driving licence for this. I have question with you, should we proceed claim on 100% ?we think he at the fault for not having driving licence , and his scooter has no plate on it.where we can find insurance center help as what your case, so he can check what is his right and what have to do . thank you |

I did just that. I asked for 1,000,000won for 'pain and medical' on the second day. They rejected my offer. Of course they ended up paying more later.
