High Court Upholds Acquittal of 'Soju Rapist'
The Seoul High Court on Monday upheld the acquittal of a man who slept with his wife's sister while she was incapacitated by drink. The court accepted testimony that the man believed his sister-in-law had consented.
In December 2003, the 28-year-old man identified as Kim, his wife, her younger sister and the sister's boyfriend, identified as Lee, drank soju or Korean liquor all night at Kims house. Kim's wife and Lee became incapacitated first and went to bed. Kim then bought two more bottles of soju and drank them with his wife's sister.

The next day, the sister learned from her irate boyfriend that he witnessed her having sex with Kim in the living room the night before. The sister had no recollection of the incident and brought charges of rape against Kim.

The Suwon District Court at first instance found Kim not guilty on the grounds of consent, ruling that it appeared the sister either consented to Kim's advances or that Kim had cause to believe she consented because she did not resist. Witnesses testified that Kim's sister-in-law often acted normal even when in a state of complete inebriation. The Seoul High Court on appeal upheld the verdict, saying although Kim's conduct flew in the face of morality, it was difficult to conclude Kim took advantage of his sister-in-law's drunken state.

I don't believe what I read! Even though I read it twice!!
The drunken korean, says the court, finds it was difficult to conclude Kim took advantage of his sister-in-law's drunken state.

Can you imagine the beating that chick must have gotten after going public about a Korean rape case? Reminds me of the news story about the Miryang school girls who were gang raped and then were ostracized for bringing it out into the open.
