Hey All,

OK, here is the situtaion. I have 3 sick days in my contract. The first week I was here, I got crazy sick, and took a sick day (Even though I was sick most of the week.) I woke up today and I am so naseous I can barely move without feeling like I'm going to boot. Untop of that, I'm supposed to give an oral test today...and my director will be there.

What to do?? Take another one ALREADY and be down to 1 sick day with 11 months left? Or go in their and possibly boot all over some kid??

Thanx..

Andy

go to the doctor. Get your meds and pay 10000 for a Jin Dan Saw. It's an official doctor's note. You'll use up another sick day, but if you're as sick as you are it may be wise.

Or you could just go to work, hack up on everybody, and explain you didn't want to use up another sick day so soon. Earn points.

Bah. Don't stress over it. Obviously, you don't know that by law you are entitled to a sick day per month, regardless of your contract. Women are allowed a few more days a year. If your boss wants to make an issue out of it, contact the labor board.

Sorry, I don't have time right now to look for a link, but there's a thread somewhere on this board that links to the labor standards act.

You will find no law in the LSA that says that people are entitled to a sick day per month.

Under the Industrial Safety and Health Act, it is stated that an employer can not force an employee to work if working would cause the condition to worsen or if infection of others is a concern, and that a person must be rehired after they get better. It does not say they are entitled to be paid while on sick leave.

I think he's referring to this:

Quote:
Article 57 (Monthly Leave with Pay)
(1) An employer shall allow one day's leave with pay per month.
(2) The paid leave in accordance with paragraph (1) may be used by a worker, of his own free will, either by accumulating or dividing it within one year.

also, if you take no days off in a year, you get an additional 10.

What are you suggesting? Section 57 refers to paid vacation time, not sick leave. And it only applies when people are working a six day work week under a monthly salary so it wouldn't even apply to most of us anyway.

In short, Hollywoodaction mistook how section 57 applies. There is no guaranteed sick-leave with pay under the law.
