Well, not yet, but he has broken the rules by going over the spending limit, according to this Washington Post story.

So has McCain broken the law? The answer is far from simple.

It depends on whether he has, in fact, withdrawn from the public matching program. McCain was certified to enter the matching program last year when he was starved for cash. But once he started to win primaries, he decided to step back from it. On Feb. 6, after his Super Tuesday victories, he wrote to the FEC to announce he would withdraw from the program.

McCain's lawyers said that gave him freedom to spend as much as he wanted -- once he announced his intent to withdraw from the system, they say, he was released from the spending caps.

But Federal Election Commission Chairman David Mason wrote McCain's campaign last month to alert him that the commission had not yet granted his Feb. 6 request to withdraw, and that the commission would first need to vote on the matter. A snag: The FEC has four vacancies and therefore lacks a quorum to consider the matter.



At this link is a draft letter to the FEC demanding they fully investigate whether any laws were broken. Feel free to use or modify it, or compose one of your own. We certainly wouldn't want any lawbreakers serving as president.

If he were knocked out, just what would the Republicans do? Are there any other candidates still in the race? Oh, yeah, I think there is still one...

I suppose you guys could beg Romney to come back, but Huckabee was the last 'alternative'.

It needs a question mark at the end, since the matter is not settled, yet.

But I see where this is going.

Imagine if the board gets all vacancies filled and they vote against McCain, but they vote after the RNC convention is held in Minneapolis (of all places). I'm not well versed on what the punishments would be, but to get stung by the very system he created isn't going to play well with his base.
If he is DQ'd after the convention, the GOP is toast. It's too late by that point. The ballot is set- there's no going back. I read that there's a process in place to replace an unelectable candidate in both parties, but the damage would be done. They'd have rally behind Romney or whomever the party bosses choose.

Now if the rules say that if a candidate does this then the whole party is DQ'd, then things get really interesting. Who are the neo-cons, the red staters, and the religious right gonna rally behind? Bob Barr? Ralph Nader?

I took your advice and put the '?.'

Now there is still another Republican in the race, but you didn't even mention him: Ron Paul. I know it is far-fetched that they'd permit an anti-war candidate to get the nomination, but you have to consider him in the mix.

One should never give up hope.
