Hey Guys,
My contract stipulates that I have 10 vacation days. The school chooses 6 of them (Aug 1,2,3..Mon Tues Weds) and Dec. 30, Jan 2nd, Jan 3rd (Fri, Monday Tuesday.) We choose the other 4. My school has been wonderful up until now, but I am pretty pissed about something-they told me that they rarely give more than 2 days in a row off, AND we're not allowed to use any days before or after our vacation period. Therefore, the longest time I will have off during the year is 5 days-hardly long enough to justify a trip to Thailand.
I wasn't going to do this, but I read somewhere that by Korean law, we are allowed one day off per month, or (if unused every month) 10 days a year off. We just recently had a teacher at our school fight and win on a tax issue (the director was taking 5% when he should've been taking 3%) so I know it is possible to take my school on. Should I bother though? Will this hold up? I don't want to be in the doghouse for naught.
Thanx

Sorry to say, I think that's about all you're going to get... 5 days off in a row, max.
I don't think you'll get anything but grief from your employer in this case. |

look at it like this. you are walking money to your director. If you go someone has to replace your classes, students might leave if you're gone for a long time etc. It's just not ecnomical for them to have you gone too long. You signed on for deal and if you wanted vacation time in blocks you should have specified it before you signed.
Take your vacation after your contract has finished. |

Then it isnt a vacation! If your contract specifies 10 days a year off you should be able to take those days off! If the hogwan didnt want you taking any vacation time they shouldnt have put the days in the contract!
BAD advice crazylemongirl...really bad! |

If I'm reading this properly, what you want to do is extend your August or January vacation. For example, you'd also want Aug 4th and 5th off in addition to Aug 1-3, so you can take a longer trip.
Okay first thing, what did the contract say? Did the contract say you couldn't take more than 2 vacation days in a row, or that you couldn't add on to the Jan 1-3 or Aug 1-3 periods?
I'm guessing that answer is probably no, which is why you're here.
First of all, I'd like to say this is BS. Your hagwon is making rules up as they go along. They should have put these rules in the contract, but they didn't. They're in the wrong, not you. It is unfair. It is wrong. It is Korea.
What I would do is try to find a replacement teacher for the extended period you want off. I think that would be the easiest way to get what you want. Bring in a pal of yours to sub in. Then I think they'll be more apt to concede. |

What do you call Saturdays? If your workplace has less than 500 or 1000 employees (don't know which one) they are not required to give you Saturdays off. |

Hey Guys,
Thanx for all the responses.
Crazylemon, as someone pointed out, if I take it after my contract, thats not really vacation. I already plan on going away when I'm done, but to keep my sanity, I would like to go away during my contract as well. I love Korea and all, but as we all know, some downtown is crucial.
Fidel, thanx for pointing that out-forgot that most Koreans work saturdays.
Badmojo-of course they're making up rules as they go along. That seems to be the name of the game around these parts. I'm going to do my best to change em. GREAT idea about the sub-I'll see how it holds with my head teacher.
Thanx again guys-
Andy

I should have been more clear. Take a long vacation after your contract finishes. take smaller paid vacations when they occur. |

I don't think that is true. As someone mentioned, Koreans rarely get extended vacations. It's so much a part of the way things are done here that it probably didn't occur to them to state it explicitly in the contract.
Use your four discretionary vacation days for Fridays or Mondays and save Thailand for after your contract is up. |

RE: Save Thailand until my contract is up
OK, any other ideas for a secluded beach vacation to refuel my sanity?
Closer destinations? OUTSIDE OF KOREA??
Thanx

You can reach many fine beaches with a 5 or 6-hr flight. Leave early, get back late -- there are ways to maximize a 5-day break into something relaxing & memorable. Not ideal maybe, but not half-bad. |

Actually, it is Saturdays which qualify. If you don't work Saturdays, then you have 4 days off per month, more than required by law. |

It should occur to them when dealing with people who aren't Korean.
This place has had foreign teachers before and I'm sure Knappstar isn't the first one to ask for vacation in a block. The reason why they don't put it in the contract is because it doesn't look good.
There's no way they can play the ignorance card here. |

It bites but most contracts stipulate your manager or director has the final approval of your days. Your school has been, by your own admission, wonderful. Considering the hagwon industry, that is wonderful. Better still, your boss seems to be keen to letting you take your days off. Just not 4 in a row, 4 hard days to off load on other teachers. So, is it worth making a stink about, if all things considered, you're happy? |
