I'm scheduled to have an operation (in Korea) and I forsee an argument coming up regarding leave. According to my contract, I am allowed 5 days emergency leave. However, this states that the leave can be used for family emergency or other types of emergencies. In order to activate these days, the director must decide whether this is an emergency. In addition, the Hogwan is expecting that I return to work 2 days after the operation. Are there any labour laws that will protect me and should I be getting paid during this time? If someone could direct me to a website, that would be greatly appreciated.

Well,

Theoretically you will have 5 days (paid) as your contract states this.

Unless you have some other sort of employement insurance (private) the other days you will take will come out of your pocket.

I don't see why you would get more.

I would check with the Labor Board if your employer balks at you taking a few days extra after your op.
