Hi all,
This is a contract I'm looking at and going in on Monday to negotiate the terms that I've added, marked with **. Any other suggestions or advice would be appreciated. And basically, how to go about negotiating .. I'm getting low on money and am getting desperate, so I would like to sign this contract as long as 2 or 3 of my major concerns are fixed. Thanks.
I. Period of Employment
A. The total agreement term is 12 months, commencing from the date of teaching in Korea and finishing on ______________.
B. The term of this Agreement includes and orientation period, six (6) consecutive teaching sessions, and all scheduled vacations and holidays that fall between or during teaching sessions.
C. The Employee will discontinue residence in Korea under the visa status sponsored by the Employer upon the completion of this contract unless the both parties agree to renew the contract.
II. Conditions of Employment
1. Employee�s Duties:
During the term of this agreement the employee will perform the following duties:
1.1 Instruction in any phase of the Institute�s program.
1.2 Curriculum design and implementation.
1.3 Development of educational programs and materials.
1.4 Extracurricular activities for/with students when needed. *Want specified*
1.5 Grading, evaluating and counseling of students.
1.6 Attendance at teachers� meetings and workshops.
1.7 Class preparation
1.8 Cooperation with the director in all aspects of employment.
1.9 Participation in other related activities. *Want specified*
2. Working hours
2.1 Classes will be held from Monday to Friday during regular sessions and two intensive sessions during summer (July-August) and winter (December-January).
2.2 The employee will be required to work at the times the employer shall direct. *from _________ hrs. to ___________ hrs, daily.*
2.3 Teachers need to fulfill the working hours of the contract depend upon needs of the institute. **
2.4 Working hours may be modified from time to time at the sole discretion of the employer depending upon a session and needs of the institute. **
3. Salary and Overtime
3.1 The employee will be guaranteed ___2.1___ Won per month for teaching __100___ hours per month.
3.2 This is to be considered as the employee�s contract hours.
3.3 Only the time worked in excess of contract hours will be considered as overtime. The employee�s overtime pay will be (20,000) Won per (60) minutes. Attendance at scheduled teachers meetings, workshops and class preparation (which is mandatory) will not be considered as overtime.
3.4 The salary will be paid on the 10th day of each teaching month.
3.5 Computation of the initial (first month of employment) salary will commence from the 1st day of actual teaching at the institute and, therefore, will not include the orientation period necessary for familiarization with the institute�s curriculum and the employee�s duties.
4. Severance Pay
Upon successful completion of a full contract period (12 months), the employee will be given severance pay which is equivalent to his/her monthely salary of ____________ Won. It will be paid in 1 month. * Change to, �It will be paid on the last day of employment.�*
5. Benefits
5.1 Housing
a) The employer will select and provide semi-furnished living accommodation for the employee usually located not far from the institute.
b) The accommodation may be a private apartment (bachelor/studio).
c) The employer will also provide furnishings which will include: a single bed, table, a chair, two-burner gas hot plate, refrigerator, wardrobe, washing machine, TV set.
d) The costs of all utilities (gas, water, electricity, cable TV, and telephone charges) and a monthly maintenance fee will have to be paid by the employee.
5.2 Vacation, Holidays
The employee will have 5 days *paid* breaks both in winter and summer as determined by the employer. *Add, "Breaks will come in one week blocks"* If the employee wishes to take additional (unpaid) vacation, he/she must give the employer at least a two-month notice before taking a vacation.
5.3 Health Insurance
The employee will b provided with health insurance coverage from the designated public health insurance corporation with 50% of the premium paid by the employer and 50% by the employee.
5.4 Transportation *Doesn�t matter, I�m already in Korea*
5.5 Visa Sponsorship
If the employee does not obtain work visa in the country of hi/her residence, the employee will receive full visa sponsorship from the employer upon arrival in Korea. This will include a paid round trip air ticket to Japan and money to cover travel expenses.
III. Taxes and Other Deductions
The following taxes and deductions will be withheld from the employee�s monthly salary:
A. Income tax required by the Korean Tax Law (approx. 5%, which may be adjusted pursue on the changed of the Korean Tax Law).
B. Health Insurance.
C. 200,000 Won per month for the first three months as a security deposit for unpaid utilities and phone charges even if the employee pays them each month. This deposit WILL BE refunded to the employee one month after this contract is completed. *Must get removed, illegal*
IV. Employee�s Conduct and Dress Code
1. During the term of this agreement the employee is expected to conduct himself/herself in a professional manner that would project a good image of the institute. Therefore, the following forms of behavior will NOT be permitted:
A. Coming to the institute and conducting class under the influence of alcohol or illegal drugs and while smoking;
B. Making sexual advances towards or entering into relationships with the students or employees of the institute;
C. Using bad language in class that would offend or discredit students, the staff and the institute;
D. Not following scheduled class timetables, canceling, starting classes late without the prior approval of director.
2. The employee should present himself/herself to students as a professional. Casual attire provided it is clan and neat, is acceptable. However, NO blue jeans, sneakers and T-shirts will be allowed (unless otherwise instructed).
V. Duty of confidentiality
A. The employee shall not disclose information relating to the contents of lectures, teaching material and business operation of the institute to any third party.
B. The employee shall not disclose information regarding his/her salary overtime payment, and contract hours to any third party, including other employees of the institute.
VI. Outside Employment and Conflicts of Interest
A. According to Korean Immigration Law, foreign workers are allowed to work legally in Korea ONLY for the employer/Institute for which they have received a work visa.
B. By signing this agreement, the employee agrees to devote his expertise, time and attention to discharge his duties to his legal employer and not to engage in any other activity that would in any manner whatsoever compete with the employer and pose any conflict between the interest of the employer and the other party and/or interfere with the performance of the employee�s duties.
C. If the employee wishes to accept any other employment, such as private or part-time teaching, editing and so on, he/she must get the directors approval before doing so. Failure to comply with this rule may result in immediate dismissal.
VII. Dismissal, voluntary resignation and liquidating damages
1. The employer will have to right to dismiss the employee if or when:
A. The employee repeatedly fails to perform his/her duties stated under this agreement including but not limited to frequent absences from the place of employment/institute without approval of the director.
B. The employee fails to conduct himself/herself in a professional manner (as described in employee�s conduct and dress code section of this agreement) resulting in damaging the image of the institute.
C. The employee commits any criminal act inside or outside the place of employment/institute. This will result in immediate dismissal with neither warning nor time for remedy being given to the employee.
D. The employee has already received three (3) reprimands (warnings) from the employer of dissatisfaction with the employee�s performance, and the employee has not rectified the situation.
2. The employee may not earlier terminate this agreement without a good reason. If required, 45 days prior notice must be given to the employer before termination of the contract.
3. In any case of dismissal or voluntary resignation, the employer will not provide a return ticket and will not give the severance pay. In addition, if the employee voluntarily terminates this contract before six (6) months of employment, he/she will have to reimburse to the employer the initial airfare and other expenses that the employer has incurred in the process of hiring of the employee, such as recruiter�s fee, housing utilities deposit and other expenses (if applicable). *Not too worried about this � flew myself over and didn�t use recruiter*
VIII. Understanding
A. Both parties have read the above terms and conditions and agree to fulfill them in good faith and will resolve any dispute in a reasonable manner.
B. All issues that cannot be solved by the two parties above will be solved in accordance with the appropriate laws of the Republic of Korea.
C. The contents of XXX Teachers� Manual are to be incorporated to be part of this employment contract. *WHAT? So the manual is also part of the contract?*
The employer will evaluate the employee every semester. The employer may dismiss or transfer the employee to other branch, if employee fails to observe his/her duties stated above. **
The employer and the employee have executed this agreement and appended their signatures on the date below:

Key areas to pay attention to marked with an (*)
* monthly wage
Expect your pay range to be between 1,800,000 Korean Won and 2,200,000 Korean Won.

* hours worked and when and what constitutes an 'hour'
You should work a maximum of 30 hours of month per week, and a maximum of 120 hours per month. Class hours are generally 45 - 50 minutes long.
* holiday and annual leave provisions
The law states you get the national holidays as holidays, and don't have to work them, but it does not state they are automatically paid holidays. At no time in the law does it automatically give public holidays as paid to anybody working a 30-hour contract. Generally most ESL Teachers get 10 - 12 days paid vacation.
* health insurance (ESL Teachers pay 50% Employers will pay 50%)

* accommodations
You should get the option of living by yourself, or with other teachers. "Option" being the key word. A clean apartment is important to have in your contract. (1) Your apartment should be furnished, and clean. (bed,washing machine,fridge,dresser,table,chairs) (2) Make sure that's in your contract. Inspect your apartment with your employer upon arrival. This will prevent you from paying for previous damages. (3)Teacher's housing is included in the contract, general utility charges such as electricity and phone along
Some schools include in their contract that the teacher must pay an 'apartment security deposit' (ASD) of 600,000 Won which is deducted from the initial pay, and is designed to cover any outstanding apartment expenses or damage caused willfully or negligently by the teacher during his stay - some schools have fabricated stories and reasons as to why the' ASD' should not be refunded - thus one should be very wary of signing this type of contract.
* contract length
Employers will usually sign one year contracts, and it's almost impossible to obtain contracts less than a year.
* taxes (Monthly withholding taxes & national pension program)
Pension taxes consist of a deduction from your salary of 4.5% matched with an equal contribution paid by your employer. It will be extremely important that you get this in your contract.

Some employers in South Korea have a track record of taking advantage of new teachers. Click on the above website, and then click on Check My Monthly Withholding Tax. That should help you.
Your employer must deduct income tax monthly from your Wage & Salary Income, based on Simplified Tax Withholding Tabl issued by National Tax Service.
Your employer is required to pay the withheld tax amount to the District Tax Office by the tenth of the following month.
Your employer must submit in February a "Receipt for Wage & Salary Income Taxes Withholding" form. Ask for a copy of this. This must be prepared at the end of your contract and is proof of Taxes to be paid to the Korean Tax Office.
* penalty clauses
Ask that they are removed from your contract, since they are a deceptive practice
* sick leave
If you don't have sick days included in your contract, then ask for 3 days.
*severance bonus
Upon completing your 12-month contract, your employer is required by Korean Law to pay you a severance bonus equal to one months regular salary. This is usually subject to normal taxes as well. It cannot be apportioned or paid out at any time prior to the completion of 12 months work. You are not able do a 'deal' with any employer, that will have him paying this bonus earlier, or monthly, throughout your contract.
Severance pay rights are covered by the Labour Standards Act of the Korean Legal Code. English-language translations of the Code are available at the Kyobo Bookstore, located near the U.S. Embassy. The key provisions of the Labour Standards Act relating to severance pay include:
Article 28(1) (Retirement Allowance System): An employer shall establish a system by which an average wage of not less than 30 days per year for each consecutive year employed shall be paid as retirement allowance to a retired employee. Provided, however, that this shall not apply in cases where the period of employment is less than one year.
Article 5 (Equal Treatment): No employer may include any discrimination in the terms of labour conditions because of nationality, religion or social status.
Article 10 (Scope of Application): The Act applies to all enterprises except small family businesses, domestic servants, and those exempted by Presidential decree.

Actually yes we can. Check out www.fthisjob.com Or type I hate my job into a Google search. There are dozens of sites devoted to people complaining about their job, often in MUCH stronger language than what is tolerated on this site.
As for the OP, looks like you have done a decent job. If you can't get the things specified, then walk away. There are better jobs out there. |

As for the OP, looks like you have done a decent job. If you can't get the things specified, then walk away. There are better jobs out there. |

Yeah this is the biggest problem IMO. You definately dont want a contract where they can change the schedule at their whim....2.4 is a deal breaker. 2.3 doesnt make much sense(aka poorly worded)
Overtime rate is a bit low i'd go for 20,000 won(or 25,000) per 50 minutes.

Change 5 days to 5 working days otherwise they might try to sneak in weekends and or holidays...Chuseok etc.

NO WAY! Tax is nowhere near 5%....its about 2% go to the NTS website and check your monthly withholding tax......taxes shouldnt change unless you are working a whole lot of overtime!

I would be interested to see what their definition of 'bad language' is....I would change it from bad to profane!

Not true...you could with permission from immigration work at a second job.

No reason needs to be given! You could quit if you felt the planets were in the third house of insanity. 30 days notice is also plenty.

I would just delete this clause....its a rape the FT clause......of you must pay for next 6 months of housing because you wont be here! We pay for one year....you leave early we deduct for lease cancellation! Oh you must pay recruiter fee for next teacher...you leave early we incurr recruiter fee.....its just such a stupid clause!

If its not in the contract it doesnt count! Delete this clause...the manual is immaterial and they cant transfer you to another branch! Your E2 visa is with this school at their location and no other! |

The holidays are crap. I'm sure you can find a job out there that offers more than a measly five days of holidays. The tax is too high. No mention of pension, which is mandatory under Korean law and is a nice bonus at the end of the contract. I would want to make sure it definitely is single accommodation too.
Since you are already in Korea, you should negotiate to get the equivalent of what it would have cost for you to get there. If other teachers get this paid for, why not you? Also, what about return airfare? Yeah, you're already there but you should be able to get money or a ticket to leave at the end of your contract. |

Only it's not illegal. It's only illegal if they say "surprise! We're keeping a deposit, thanks for playing." Deposits (and other deductions) are fine if they are mutually agreed to. |

Thanks for the feedback everyone. Big Mack, I did negotiate a higher salary - from 2.0 to 2.1... and it states that i get 5 days both in winter and summer, so no worries there. I also managed to get Saturday's removed during the interview... but it was such an ordeal! I've got the feeling that trying to negotiate these new things will be a f**king headache, but I've got to try because realistically there are not contracts out there that are in the interest of the employee. Most that I've seen out there are pretty similar to this one or worse. Thanks again! |

You mentioned in an earlier post that you were getting low on money and are ready to take anything. I hope you didn't point this out to your potential employer, because it might put you in a bad negotiating position. He might think that he doesn't have to budge because you're desperate enough that you're going to sign anyway.
I realize you're short on money, but really, if he's hard to negotiate with and you're not happy with the contract you should keep looking. You don't want to go through hell for a year and be regretting it later. |
