Man to be retried on charge of raping his son's girlfriend
In January 2004, the 50-year-old man drank Soju, a traditional Korean liquor, with his son's girlfriend, identified by her initial J, in a bar after the 17-year-old phoned to give him new year's greetings.
Then J went with the man to his home at around 11 p.m. with the aim of changing her boyfriend's mind because he had ended their relationship. K assured the girl that he would encourage his son to change his mind.
However, K demanded that J and he go to a nearby motel because he said his son might become upset if J slept in the home. They went into the motel at around 2 a.m. and K then allegedly forced her into a sexual act despite J's objections, the girl claimed.
The core issue in the Supreme Court's decision was whether the sexual relationship could be considered rape in terms of the alleged force applied by K. The court heard that there was no physical violence involved, but could not clarify whether or not psychological pressure may be defined as force.
After the alleged rape, J met another man whom she knew through an online chat web site and slept with him the following day. She came back home late at night the following day and confessed to her family that she had been raped by K, after questioned why she spent the night away from home.

But it does. After being raped, that is a very unlikely response to it. |

Is that a gut reaction, or do you lnow of any research about the behavior of rape victims?
Serious question, honestly not meaning to sound like a smart arse
I actually just googled "post rape sex", but didn't find anything relevent, not that I looked through every google page.
I just don't see how her behaviour after the fact reflects on her statement that she objected the night before with the old guy. |

The comment about the internet chat room fits with the context of the full article on koreanherald. Missing from RR's post was:

Part of the Seoul High Court's decision to find him not guilty, was also based on her willingness to have a chat room booty call, the next night. |

Ok that's what the Korean court decided, I'm just not so sure if that would hold sway over western or female judges. Granted this is Korea and it's for a Korean court to decide.
I don't see how her staying in the room proves anything.
Other factors may have played a part, was she scared of him? Did she fear being caught by him if found trying to leave?
I still don't see the connection between saying yes the next day and saying no the night before. Is there like a set time rape victims shoud wait till they have consensual sex? I honestly can't believe the judges took that into consideration.
By the way the article said she was 17, isn't the legal age about 20 in Korea?  |

Psychological pressure isn't considered force here?
I'm sure it is in alot of other countries.
The notion that it is only rape if the girl fights for her life, is I thought, a rather ancient one.
She's too young to legally drink and too young to legally have sex.
The guy gives her soju and has sex with her.
I can't see how under the law that can be anything but rape |

Why would anyone with hald a brain want to meet someone and slep with them the next day after being raped even if you were not raped why sleep with someone so soon? |

Common sense. When someone is raped, generally they don't go out and have sex with someone the next night. Standard behaviour of most rape victims include feeling of guilt and low self-esteem, a desire to be alone more. I just can't see it happening. Sounds more like she is attempting to get back at her boyfriend for breaking up with her. |

It sounds more like molestation or date rape, even though she is of age, it has all the familiarity of it.
She stayed in the hotel, if she was raped violently she probably wouldn't have stayed in the hotel, she would've got her ass out of there, perhaps.
The behaviour the next day is indicitve of molestation or date rape because theres a lot of shame involved.
Whose to say that she wasn't raped, we are male so unless you have had this happen to you, our views will be somewhat different |
