|
|
I signed a contract to work at a company A (through a recruiting company)in a small city but the government wouldn't allow a foreigner to work there, only a gyopo.
Since then I have worked for the recruiting company B in a large city. My question is - Is my contract void because I am not working at company A in the small town. The name of that company - A - is on my contract. Can the recruiting company keep me - they sponsored my work visa. |

Yes, you're working illegally for the recruiting company (B), if another company (A) sponsored your visa. |

Yes it is wacky, the recruiting company can't make me stay with them if I signed on to work at a different location right? |

Since recruiting company B sponsored your visa, it seems likely that they are a party to the contract. Who signed it? Did you actually make the contract with recruiting company B or company A? Or possibly both A and B. If you and B both signed the contract, and you have been working under the contract for 8 months, then you have essentially ratified the change in working location. Another question would be the location of your actual teaching. This location should be indicated somehow on your visa and ARC I believe. Is there any discrepancy there? You need to give more info. here. |

Yes I am working in Seoul but the contract and my ARC both have the small city on them. I signed it with company B but have only been working for about 2 1/2 months in Seoul. |

It sounds like recruiter company B is your employer. Since the wording of your contract was not posted, I cannot see whether or not there is any breach. Your contract is probably not void. However, it does appear that you need to register your new workplace with immigration. There is some paperwork and a small fee to pay to make you "legal" again. Talk to your boss about getting legal. The employer should make the calls and do the paperwork. If they are nice they'll also do the legwork and pay the fee. But push to get legal. The penalties will fall hardest on you if you're "caught" by immigration. |

Had a friend phone immigration and they said if your work location does not match your contract and ARC you can be fined. Since I hate my job it is the perfect time to get out. |
