So I enjoy Lost and I download it everyweek off Torrentspy.

I'm curious, is that legal? I live in the UK so I technically I couldn't get it yet, but what about someone in the US, it'd be ok for a friend to video it and then sending across.

I've always wondered, seems a pretty grey area.

I think on the most part its no.. I know that any show that is available on sale either on video casette or dvd is illegal to distribute even if its ripped of tv.

So if I videoed something off tv I am also breaking the law? How about if I gave it to a friend? I'm interested in how the medias compare.

Its no biggie tho, if peeps are gonna stop illegal stuff in Korea I'll worry when the bootleg dvd runners are all shut down in yongsan Smile

In some countries, yes. Though the U.S. Supreme Court has ruled that it falls under "time shifting" and is lawful.

If they do not already lawfully own the product, it's distribution and unlawful.

one of my friends works in intellectual property law and I asked him about this kind of thing.

According to him, if the thing being downloaded isn't available by normal commercial means, then that's a valid excuse in many jurisdictions

the standard for criminality was always distribution for the purposes of proft. this stuff has been going on way before the internet, remember blank tapes? I remember having about 300-400 copied tapes in a pile in the back seat of my car in high school. As far as I'm concerned, the internet has provided an easy excuse for companies to get "lost revenues," because they couldn't do anything about it prior.
