Bare with me on this one...

Just went for my daughter's 100 days appointment at a photo studio set up by the hospital where our baby was delivered. At that hospital, they give us a free special deal with this photo studio where you go to the studio when your baby is 50 days old, 100 days old, and just before the 1st birthday. These three appointments are for a 10 minute video that they make for free (the deal with the hospital) to show at the "dole-jan-chi".

Of course, the special deal is to get you in the door to suck you into buying their precious photo albums (the cheapest one at this studio goes for 600,000w). So they take a bunch of pictures (on top of the video) in the hopes that you will see the photos of your little darling and be swept off your feet and order these ridiculously-priced photo albums.

Alright, so we just asked them if we can have (and pay for) the negatives and digital camera files of the pictures they took and we will make our own albums. We were told we can't have them. They said we can't have the negatives unless we buy a photo album. If we do, then we can get the negatives, but if we don't order, we can't get the pictures. Basically they are holding the photos for ransom...

In a similar story, a co-worker of mine had this same problem at another studio (apparently this is the way they operate here), and long story short (too late), he got his brother-in-law (a lawyer) to threaten the photo studio and told them that it is illegal to withhold the photos. After much back and forth, the studio gave in (reluctantly) and sold the negatives for a little over 100,000w.

And to top it all off, they were rude as hell. When doing the video, they choreographed everything in a ritualistic, but un-natural way, and then try to get you to make the baby smile. When our baby wouldn't smile (who would - it was uncomfortable as hell, the way they set it up), they said 'you are unfamiliar with your baby', and 'you obviously don't play much with your baby' and other such hurtful things.

Bottom line is: how can I get the photo studio to sell us OUR goddamm negatives?

Your chances of getting a photo negative from a photo studio are slim to none. The way photo studios make money is to sell you copies and then re-sales of copies later. They would be cutting their throats to sell the negatives as well...essentially if you go to a photo studio for pictures...the artistic merit of the picture actually belongs to the studio...in a way, you are simply paying for the reproductions of their art.

Interesting post, Poet. I can see the argument you're making. Then again, 100,000w~120,000w for negatives of a few (40-50) pictures (total time taken = 45 minutes over 3 trips) seems reasonable to me. Hell, that's a nice sum of cash for under an hour's work.

I'm not sure exactly how this goes back home (I'll have to get informed), but I can't see them refusing to sell the negatives.

Also, my friend's brother-in-law (lawyer) said they can't legally keep the negatives, that the pictures have your images on them, and they they must be made available to you. Maybe I'll get this friend's brother-in-law to intervene for me too...

I have NEVER received negatives from a professional photographer in the US. Not when I hired a friend privately, not from the Wal-Mart studio, not from the people who take school pictures. Friends who were married in the US did not get the negatives from their photographers, either. You are expected to pay them for reprints.

I'd be surprised if they had any legal obligation to sell you the negatives- just like they don't have any legal obligatoin to sell you the prints. I mean I'm sure they aren't allowed to use either without your permission but that's probably about it.


600,000 for a photo album? Wow that's a rip off- I'd go to a professional children's photographer- which I see all over the place, and pay a lot less for what I assume would be a much more pleasant experience.

Yes, it is a rip-off, and like I said, the 600,000w album was the cheapest one they had. They had these other, smaller, mini-albums going for 300,000w and up, but they would only have contained about 10-12 pictures.

Incidentally, the name of the place is ���̽������, which specializes in baby pictures & videos. The only reason we went there in the first place was cuz of the freebee deal we got at the hospital with this studio.

I also was surprised when my co-worker told me that they had no right to withhold the negatives, but his first-hand account was good enough for me (plus it suited the way I wanted things to work out). Now, from what other posters are telling me here, the studio reserves the rights to hold onto the negatives, but they can't use them without your consent, which makes sense, too.

To put this in perspective, my wedding album was shot in Busan for 1.2 Million. This included numerous wall-sized framed prints, and three books of pictures with 50-60 poses, and the digital files as well (granted, most places don't do that). 600,000 for a cheesy album is beyond a ripoff and it's likely that this "gift" was given after paying the hospital for agreeing to promote it.

sure is small world..

I had this SAME VERY problem 2 years ago.. with my daughters 6th birthday..
same situation as you.. I went in to have pictures done for this talent website of course you can only go to the photo studio which is selected in on the webiste in your location.. ok thats fine..
so we get down there and I let me wife take care of paying the bill I go get the car.. she comes down gets in before I take off I ask to see the pictures.. I take a look, I think garbage really I could have taken them 100 times better myself , but to have your child on the site you must have it done by this idiot and pay the money.. and way we get this kinda big frame picture aswel. then I ask my wife, ohh were are the negatives?
she says I dont know.. ohh call him up and ask him to prepare the negatives I will come straight up and get them..
she calls , he tells her, sorry I used a digital camera..
im like ok.. thats fine.. I want the origial digital photos you took on disc DO NOT RESIZE THEM!!
he says no you cant have them!!
I then tell my wife , dont ask him. tell him we are coming up to take the original digital pics from you so please start burning them into disc now!
he says.. no! I say WHAT!! we are coming up!!
before I park the car and about to get up the phone rings!
he says im sorrry but I will sell them to you for 600.000 won!!
im like I just paid 300.000 for your money service already!!
why would I have to pay 600 more for something which belongs to me!?
he says they dont belong to you. they belong to me!
im like no the model in that picture my daughter belongs to me!!
you can in no way use her without my concent! I have not signed any release form ...
he says you want it 500.. 500 now???
I hang up and go upstairs!!

now I have a short fuse when it comes to IDIOTS! otherwise I can be pushed along way! but its something about moron korean men that spark me off straight away..
I walk straight up, right into the studio he tries to tell me to take my shoes while he is with some ajumas who about to be frauded but this guy. I WALK straight in and SAY F**** YOU and grab the A hole and tell him to get my pictures right now!! he trys to fight with me.. the female worker is freaking out.. the ajumas I send out tell them in korean that he is a fraud and has stolen money from me so they leave!! and now buddy must be hearing rockying music in his head and decides he wants to play with me
IM COOL WITH THAT! he tells me to leave his store.. I say not without my pictures.. he says I told you 600!!! 600?? you said 500!!
now its 600.. I said no idiot.. now its free!!
I walk into his office and go straight to his cameras and pick it up!!!
and then say come any closer to me and I will smash this camera on the floor.. now buddy is freaking out and he is asking for the police..
the female worker calls the police. IM like cool!!
now of course we are cussing each other like a eddie murphy movie..
my wife knows my tolerance towards stupid korean men and she knows I will just start a fight with this idiots.. so she was not far behind me. at this moment she walks in.. he tries to talk to her and tell her to tell me to do something.. I walk up to buddy and grab him by the shirt.. and cuss him in korean and tell him you got a problem with me , not with her !!
we then fight some more.. we are both same build so it was more strenght pushing than punching becuase we both know who ever punches first will be paying! so we both didnt go that far especially with witnesses
then the cops come so we broke off. and sat down to talk about it..

I thought for sure I am done!! the cops will favor him...
but they listened to both our arguements.. and then my wife told the police man we wanted the original size pics.. and he is trying to charge us 600.000 won for them.. which just come off a camera!!
the cop was classic.. he GOES WHAT!!!! CHINCHA!!!!!??
then you should have seen the photo guys face.. he thought being all nice to the cop and greasing to him the last 20minutes he was gonna see the back of us..
the cop looks straight to him and GOES!! why are you 600.000 won for some pictures! are you crazy????
hahahh he then goes.. umm no becuase its business..
BUSINESS?? business to robb people?
YA SEKYA! you give them the pics right now!!!!
he then says no!!
hahahahahahah
the cop gets up and does the loudest MOOOORRAAHHHHAGO?????
the studio guy goes.. ANI.. Embarassed
I dont have them! I deleted them! me and wife go BSHIIITTTT!!!
you told us 500 or 600!! of course you have them!!
the cop goes PALI ! go get them!!
then he makes a disc.. and gives it to my wife..
now!!
the cop goes to if you want to press charges and report him for fraud and over pricing which I recommend you do.. please call this number!!

we are like naa put this behind us I got the original pics so I am happy..

the whole reason was the frame picture had serious pixels in it. so he used a low resulotion pics.. so I wanted the originals so I could blow them up myself...
we take the disc and walk about.. I get home and check the pics..
and they were all resized down to 150k ARRGHHHH!!!
I was ready to jump into the car.. but my wife was like forget it!
im like yeah!! F***K HIM!!!
so thats the story..
call the cops man!!

Great story, Itaewonguy - thanks for sharing it...

I wish I had balls of steal, like you, but somehow, I think I'll try the diplomatic route, as well as get better informed about my rights over the negatives first.

But going in there guns blazing is exactly what I'd like to do...
