I was just reading another post about not taking vacation and a light bulb appeared above my head.
Should vacation time not taken be considered overtime? I know it would be quite a task to convince your boss of this, but just out of curiosity. Maybe not. Don't think it is back home.
Has anyone here gotten or heard of anyone getting OT pay for vacation days not taken? Hmmmm. |

No. It's not overtime. Many places in the US will not pay for vacation not taken. It's use it or lose it. Some employers will reimburse for cash, but that's the best you can hope for. |

Just curious. I kind of realised in the middle of my posting what the deal was.
I'll have 4 out of 10 days taken by the time my contract is over. In this case, however, it's not use it or lose. A cool 440,000 Won.  |

Under Korean labor Laws, any vacation time not used during the year is lost and cannot be used any other way.
i.e: boss pays you more money not to use them or you ask boss for more money cause you didn't use them.
Sucks, I know. In Australia we usually get to roll them over to the next year. I once worked with a guy who hadn't taken any vacation time in over ten years. He'd racked up nearly an entire year of paid vacation time (the lucky bastard). Eventually, the company asked him to starting taking vacation time and to start using the accumulated time as well. He didn't know what to do with himself as he was a workaholic. |

It may not be considered overtime, but at my Hakwan job last year, I had 7 days, of which we took 4 during the summer and winter when the school closed. At the end of my contract, the director paid me 3 extra days in my final pay envelope. She did this without me asking for it or mentioning it.
It always, always, always depends on the disposition of the director you work for and how human they are.

7 days? That doesn't sound very humane to me.
Of course you should get paid for vacation not taken. The boss is the one forcing you not to take vacation. The same works back home. It's called "vacation pay". |

couldnt you get a clause in before you sign your contract?
interesting point, i never thought about vacation pay. my contract gives 14 days, and 7 of those can be rolled over to the next year if not used. |
