I have been offered a postion at Ahil School in Ulsan and was wondering if anyone could tell me anything about the school or the city. I've been sent the contract and it seems ok but I'm new to this game. So I've posted the contract too any help would be greatly appreciated! Thank so much!!
AHIL ENLGISH SCHOOL
EMPLOYMENT CONTRACT FOR INSTRUCTOR
This employment agreement has been made on January 6th, 2006 by Mary Whorl and AHIL ENGLISH SCHOOL, a corporation organized and existing under the laws of the Republic of Korea.
WITNESS
Whereas the employee has been selected and approved by the employer to teach English, employee and employer, in consideration of the mutual promises and covenants contained herein, agree as follows:
1. EMPLOYMENT OF EMPLOYEE
1.1 Employer hereby employs Employee to teach the English language in the form and manner and under the terms and conditions set forth here in this agreement.
1.2 Employee hereby accepts employment from employer to teach the English Language in the form and manner and under the terms and conditions set forth here in this agreement.
2. PLACE OF EMPLOYMENT
2.1 Employee will be employed to teach the English Language at the address of the principle office (482-138 SEOBUDONG DONGKU ULSAN, SOUTH KOREA 682-030).
2.2 As further provide herein below, from time to time Employee may be required or requested to teach English Language outside and apart from institute.
3. DUTIES OF EMPLOYEE
3.1 During the terms of this agreement, employee will accept, obey and strictly comply with the instructions, supervision, training and discipline of any and all phases of the instructional program, administrative duties related to the employee's classroom duties, attendance at scheduled staff meetings and workshops, and any other duties as may be assigned by the director. The director is responsible for establishing Standards of Performance relative to the employee and is empowered to take all reasonable steps necessary to assure those standards are met.
3.2 During the term of this agreement the employee will be required to perform work assigned him/her by the director. Work days are Monday to Friday. Nor regular schedule of work hours can be guaranteed to the employee. Unless otherwise approved by the director. Work duties will refer to class from the first to the last day of the month.
3.3 The teaching hours are 120 hours per month. The teaching hours are counted by the minutes. Attendance at staff meetings and workshops are not considered overtime. Employee will be paid, in addition over and above the salary set forth herein below, a rate of 18,000won for each hour of overtime.
3.4 Employee understands and agrees that at all times during the term of this agreement, the employee will strictly adhere to and obey all laws, regulations, provisions, instructions, and guidance from the Government of Korea or any other local government there of.
4. COMPENSATION AND OTHER TREATMENT OF EMPLOYEE
4.1 Salary
Employer will pay employee as compensation for all services rendered the total aggregate monthly salary of 2,000,000 won for each month of the contract period with employer. Payment for part of a month of employment (at commencement or termination) will be calculated on the number of days employed. Payment of the aforesaid salaries will be made in Korean Won. This salary will be paid on the 15th day of each month. Korean income tax and Korean National Pension Scheme will be withheld.
4.2 Holidays
Employee will observe holidays as scheduled by employer and detailed in a yearly calendar provided before the commencement of the year to which the calendar refers.
4.3 Paid Vacation
Employee will receive at least 10 paid vacation days or more on schedule during the contract period. Vacations can only be taken as scheduled by employer with at least two week's notice given to the employee as to when the vacation will be scheduled.
4.4 Sick days
Employee will be given three sick days with pay per each contract period.
4.5 Housing
Employer will select and provide furnished living accomodations for employee. The accommodation is a studio which has a bathroom, a small kitchen area and a balcony. There is a refrigerator, two burner of gas stove in the kitchen area. There is a bed, a desk, a chair, an air conditioner and TV. The place has floor heating system, Ondol. There is a washing machine.
The cost of monthly service, utility something like electricity, water and gas will be paid by the employee every month.
4.6 Transportation
Employer will purchase for Employee economy class ticket from the point of hire for passage on a regularly scheduled to Korea. In this event, Employee completes the full contract period, Employer will purchase for the Employee who continues employment under a subsequent employment agreement with Employer, the return air ticket will be provided at the time of completion of the subsequent contract period(s). If the voluntary resignation occurs before 6 months of the contract has been completed, the employee must refund a percentage of the airfare equal to the percentage of time remaining in the six months of employment.
4.7 Health Insurance
Employee will be covered by medical health insurance. The cost of this coverage will be borne half by Employer and half by Employee.
4.8 Severance Pay
Dependent upon completion of the full contract period, the Employee will be given an additional one month salary as severance pay. Korean severance-pay tax will be withheld.
5. TERMS OF AGREEMENT
The terms of this agreement shall include 12 full and consecutive teaching sessions and all scheduled vacations and holidays which fall between or during teaching sessions. The total agreement is approximately 12 months. As agreed upon by the employer and employee, the contract period commences February 20th, 2006 and finishes February 19th, 2007. This period of time shall be considered 12 month teaching sessions.
6. DISMISSAL OR VOLUNTARY RESIGNATION
6.1 Employer will have the right to dismiss employee for clear and frequent neglect of duties under this agreement, including but not limited to frequent absences from the place of employment without approval of the director or good reason therefore, prior to any such dismissal. Employee will be warned of dissatisfaction with performance and will be afforded at least twenty working days in which to remedy the situation. Criminal or other serious conduct inside or outside the place of employment that would in the opinion of the director, seriously jeopardize any student or staff person, or the reputation of the employer, will be cause for immediate dismissal. No warning or remedy time will be allotted. In case of voluntary resignation, employee must give a 8 week notice for school and the employer will have no duty and will not be obligated to pay the cost of airfare to place of hire.
7. FINE
As a teacher at AHIL, the teachers must not be late for class and must not miss a class without providing 24 hour notice. Accidents, illness and situations beyond the teacher's control are, of course, exceptions. If the teacher breaks this promise, they will pay a fine. For each late class, AHIL may deduct one hour's pay. For each class missed, AHIL may deduct one day's pay.
EMPLOYER AND EMPLOYEE HAVE EXECUTED THIS AGREEMENT ON THE DATE INDICATED BELOW, INTENDING TO BE LEGALLY BOUND HERETO, AND IN WITNESS WHERE OF EMPLOYER AND EMPLOYEE HAVE APPENDED THEIR SIGNATURES.

Make sure that you have permission from immigration(a second stamp on your ARC) for any other teaching location.

I really dont like the bolded part...I would delete it or rephrase it

Warning. with this you can be given splits or called in for classes. You could even end up working from 9-9!

120x60=7200 7200/50(minute classes)=144 classes a month=36 classes a week...which 7-8 classes a day....too many IMO. Overtime is too low as well 20,000 is standard

Should also be some mention of health care. Make sure the taxes are at the rate they are supposed to be...check tax rate under FAQ..go to the nts website and check monthly withholding tax...on 2 mil its about 30,000

Pretty standard...if you want anything not listed put it in or request it ahead of time.

Im a little confused here. You have to renew your contract in order to get airfare home? Get them to clarify this...very poorly worded.

Once again this 12 teaching sessions crap. Your E2 visa is only good for one year, 365 days...if you overstay you can be fined. If you start work halfway through a teaching session this clause says it doesnt count towards finishing your contract!

4 weeks is standard...you dont have to give 8

Sorry clause 7 is illegal. There is no way in hell I would agree to it.

So is this saying you will work where ever boss man says?
Get it put into the contract that you will work only at the school.
3.3 Pay by the min...wtf? So if you have a 5 min break between class to get a glass of water, or to take a leak...it's on your own time. No way.
18000 won an hour for overtime. 20k an hour would be crap. That's an insult to see if you can figure out you'll be making almost the same weither you work regular hours or overtime.
Tell the employer that he will also supply
1) curtains
2) Bedding
3) eating and cooking utensils
4) anything else you think you need.
You should put nothing of your own money into your home. They should pay for basic living stuff.
Other thn that....it's a not so good contract.
You can do better than this. |
