Maybe you may want to talk to Efl-Law first. You seem to be saying things that sound like law but may not be. It isn't true that if you work six months or more then you should get a months severance. The full severance comes after a finished year of work. You also say that a visa run must be paid for by the boss but it isn't in your contract (You may want to check to see if the school is legally required to refund that cost, because I don't think they are). This isn't a court of law and if you lose your important papers, don't expect the boss of the school to help you attack them Rolling Eyes .


I would put things down in a logical manner and talk to efl-law and see if you have a winable (word?) case.

regarding your visa run: i understand there was no clause in your contract regarding payback, but i think you owe that money anyway. the reason being that you resigned well before the six month mark. up until that time you are required to pay back your airfare...so i assume a visa run would also fall under that responsibilty.

regarding the Gunsan job: not having the contract may not be a problem. i say 'may not' because a lot depends on the particular labor office agent you speak to. as you know, korea hasn't really got the concept of 'policy' quite worked out yet.
if you get an agent that adheres to labor law, he will enforce it over contract law. labor law always trumps contract law. as long as you have proof of pay, and proof of your start and end dates, you should be alright.

however...
seeing that you are leaving the country at the end of next month, i would hardly say that is enough time. when i went through this process, my emplyer ignored the labor board's ruling in my favor. we actually went through 2 hearings, as he can appeal. he lost both times. i then was advised to file with small claims court. this is what took the most amount of time, as he tried to milk the system.
in total, it took almost three months for me to get my money.
