Employment Agreement
LCI Kids Club
#786-15, LCI Kids Club Bldg. Yoksam-dong, Kangnam-gu
SEOUL, KOREA 135-080


This EMPLOYMENT AGREEMENT has been made by and between LCI KIDS CLUB (hereafter referred to as "The Employer") and _____________________citizen of (hereafter referred to as "The Teacher") _____________________

I. EMPLOYMENT OF TEACHER

1. Within the parameters of Korean Labor Laws, The Employer hereby employs The Teacher to teach ESL classes under the terms and conditions set forth here in this Agreement.
2. Within the parameters of Korean Labor Laws, The Teacher hereby accepts employment from the Employer to teach ESL under the terms and conditions set forth here in this Agreement.

II. QUALIFICATIONS

The Teacher must be judged qualified to teach and be able to submit all the necessary documents required by the hiring procedure of the Institute. The minimum qualification is an undergraduate degree from a recognized institution in an English-speaking country.

III. PLACE OF EMPLOYMENT

1. The Place of Employment will be, # 786-15, LCI KIDS CULB building, Yoksam-dong, Kangnam-gu, Seoul, Korea.
2. From time to time the Teacher may be required or requested to teach outside and apart from the place of employment.

IV. DUTIES OF THE TEACHER

1. During the term of this agreement, the Teacher will accept, obey, and strictly comply with the instructions, supervision, training and discipline of the Program director. These duties will include instruction in any and all phases of the instructional program, administrative duties related to the classroom duties, lesson planning, attendance at scheduled staff meetings and workshops and any other duties as may be assigned by the Academic Supervisor. The Teacher will teach from Monday to Friday.

2. Any time worked over 130 hours per teaching term (session) is deemed overtime. Only classroom contact hours in excess of over 130 hours per session approved by the Program director are considered overtime. Attendance at any scheduled staff meetings, counseling for feedback, preparation for class, lesson planning, writing evaluation report, workshop are not considered overtime or teaching hours.

3. When the teacher is scheduled for less than 130 teaching hours per teaching term, special duties will be given to make up for the 130 teaching hours, under the supervision of supervisor.

4. Teacher must inform Program director or Academic coordinator of any necessary changes in classroom or hours.

5. In the event that the Teacher must miss classes or be late for a valid reason which the Employer finds acceptable, the Teacher himself/herself must inform the Employer at least 2 hours in advance to allow the Employer to arrange substitutes.

6. If the teacher needs to call in sick, the employer should find the reason acceptable and/or the teacher should provide a doctor��s written diagnosis.

7. The Teacher should submit lesson plans, student report cards, and other academic or administrative documents, etc which are necessary, to the Academic coordinator on time as scheduled.

8. The Teacher is not allowed to perform ESL instruction outside the designated classroom without prior approval from the Employer.

9. The Teacher must not make public information that the Teacher obtains at the institute, while employed or subsequently.

10. The Teacher shall not accept any outside employment whatsoever, without specific written permission from Employer.

11. At all times during the term of this Agreement, The teacher should respect the rules and standards of conduct of LCI Kids Club (written, verbal and tacit) and the Teacher understands and agrees that s/he will strictly adhere to and obey all laws, regulations, provisions, instructions and guidance from the Government of Korea or any local government of officials. The teacher is required to be punctual, reliable and most of all professional in representing LCI Kids Club.


12. The Teacher is required to substitute for other teachers when necessary.

13. The Teacher must follow the school��s program, which is instructed by Program Director or academic coordinator..

14. For marketing purposes, the teacher��s profile (including name) may be placed on a brochure or Internet, etc.

15. The Teacher is required to come to school 20 minutes prior to the first scheduled class for class preparation.

16. Working hour is from 9:30AM ~ 7:00PM, during students�� vacation, working hour begins at 8:50 (summer and winter vacation time: one month each) and the early class will be given on voluntary basis.

V. COMPENSATION AND OTHER TREATMENT OF TEACHER

1. Salary
The Employer will pay the Teacher 2mil won as compensation for all services rendered. Payment for employment will be calculated every teaching term and be made in won.
This salary will be paid on the 5th day of every month. The Teacher will be paid 60,000won for each training day for the first month. Korean income tax will be deducted from the Teacher��s salary which will be 3.3%~5.5%. The Teacher��s salary determines the actual amount to be deducted as per Korean labor laws and government directives.

2. Overtime
If the Employer requires the Teacher to work in excess of 130 hours per teaching term such overtime or extra hours shall be paid for, in addition to the monthly salary, at the rate of 17,000 Korean won per hour.


3. Vacation
The teachers will receive 1week summer vacation and 1week winter vacation as scheduled by the school.
Vacation days will include Saturday and Sundays or holidays.

4. Housing
The Employer will select and provide furnished living accommodations for the Teacher.
LCI Kids Club will provide teacher with an apartment/house shared by other LCI Kids Club teachers. The accommodation may be in a two-bedroom apartment. Each teacher will have a private bedroom and will share a kitchen and bathroom.
Furnishings provided by LCI Kids Club for common use include: a kitchen table and chairs, a stove, a refrigerator, a telephone, a television, an air conditioner and a washing machine. Furnishings provided to each teacher include: a bed, a wardrobe and a fan. The cost of monthly service like management fee, telephone charges and the cost of utilities for the accommodation provided will be paid by the teacher. It is the Teacher��s responsibility to maintain the apartment while living there, and to vacate it in the same condition as it was initially occupied. .

5. Transportation and Travel expenses
Employer will provide the Teacher with a one-way economy class ticket to Korea. If the Teacher completes the full contract year, the Employer will provide the Teacher with another one-way economy class ticket from Korea to the point of hire at the time of termination of employment
6. Severance pay
Severance pay, equivalent to one-month��s salary, will be provided to the Teacher upon completion of the one-year contract.

7. Medical Insurance
Teacher will have Samsung insurance plan (Please see Appendix A for details). LCI Kids Club will pay the half of the premium to enroll the plan.

VI. SALARY DEDUCTIONS

1. In case of an absence, the amount equivalent to 1/20 of one-month salary will be deducted from the Teacher's salary, when the absent sick days are more than 3days in a year.

2. In the event that the teacher is absent for a not valid reason which the supervisor finds it unacceptable or personal, the amount equivalent to the scheduled teaching hours for the day will be deducted from the Teacher's salary.

3. The Teacher has to be punctual for classes. Three late arrivals will count as one absence.

4. If the Teacher fails to complete the contract through his or her own fault, the Teacher shall pay back the total amount paid by the employer for airplane ticket or 1,000,000won if the teacher had received money instead of air ticket.

VII. RENEWAL OF CONTRACT

1. Employer and Teacher may renew the contract for the period of one year.

2. The Teacher shall notify Employer of the Teacher's intention of renewing the contract in writing at least 60 days prior to the termination date of contract.

3. The Employer shall notify Teacher of their decision in writing at least 60 days prior to the termination date of contract.
4. Pay will be negotiated according to teacher��s performance of his/her initial teaching year.`



VIII. TERMINATION OF CONTRACT

Employer will have the right to dismiss the teacher for clear and frequent neglect of duties. When appropriate, prior to any such dismissal, the teacher will be warned of dissatisfaction with performance and will be afforded at least twenty days in which to remedy the same. Employer reserves the right to terminate this contract for the cause with written notification sixty days in advance and for serious cause without notice. In the event of termination of contract, employer will not provide a letter of release to the teacher, unless negotiated otherwise.
The causes are like followings when:

1. The teacher is found to be in breach of contract.
2. The teacher is involved in a bad scandal that may tarnish the reputation of Employer and school.
3. Other circumstances for which the teacher is responsible make it undesirable for employer to continue employment.
4. Unexcused absence occurs more than twice in a two month period.
5. Employer concludes that the teacher cannot perform class activities, or lacks the qualities necessary to be an effective teacher/employer.
6. The documents submitted to Employer are proved to be counterfeited.



IX. EMPLOYER PROPERTY

The Teacher must return the following items when the contract terminates:
1. All the things that Employer has rented or lent to Teacher.
2. Teaching materials.
3. Reference books owned by Employer.
4. Any other property owned by Employer.

X. COVENANTS

1. The Teacher hereby agrees that he/she will not undertake any teaching or employment with any people or organizations other than Employer without prior approval. Failure to comply with this clause will result in immediate dismissal.

2. Teacher hereby agrees that at all times during the term of this agreement or subsequent to the termination of the agreement, the Teacher will not use the name of the Employer for business purpose.

XI. INDEMNIFICATION CLAUSE

1. The Teacher will indemnify and hold harmless the Employer from any damages which Teacher may sustain, in any manner through the misconduct or negligence of Teacher.

2. The Teacher will indemnify and hold harmless the Employer and the Employer's representatives from any damages that Teacher may sustain, in any manner, through the refusal by The Government of Korea to permit entry to the republic.

XII. GOVERNING LANGUAGE

This agreement has been drawn up and has been executed in the English language and the
English language text of this agreement will govern and prevail over any translation.



XIII. MERGER CLAUSE

This agreement constitutes the entire understanding between the parties with respect to the subject matter and supersedes all previous negotiations, commitments and writings.

XIV GOVERNING LAW & JURISDICTION

This agreement will be interpreted according to the domestic laws of Korea. A competent court in Korea will have jurisdiction in regard to any dispute or claim arising out of, or in connection with, this agreement. Employer and Teacher have executed this agreement on the date indicated below. Intending to be legally bound and IN WITNESS WHEREOF, the Employer and the Teacher have appended their signatures.

XVI. PERIOD OF EMPLOYMENT

The period of employment under this contract is from to .
In the event of the teacher's actual arrival on the job does not take place on the commencement date above, the contract period will start from the actual working day. If the contract ends in the middle of the term, the teacher will agree to teach until the last teaching day of that term.

Appendix A

Accidental injury / Death or permanent impediment
Death or permanent impediment as a direct result of injury sustained through sudden and accidental occurrence.
Death: Full amount insured.
Permanent impediment: Sliding scale from 3~100% according to the degree of impediment.

Accidental injury / Medical expenses
Medical treatment for injury sustained through sudden and accidental occurrence. Medical expenses actually incurred within 180 days from the date of accident but not exceeding the limit for medical expenses.

Sickness / Medical expenses
Medical treatment for sickness.
Medical expenses actually incurred within 180 days from the date of the first medical examination but not exceeding limit for medical expenses, less deductible of WON 100,000

Special expenses
In case of disappearance of the insured/ In case of death or hospitalization for more than 14 days/Search and rescue expenses/Transportation cost including air fare/Hotelroom charges/Repatriation expenses/Miscellaneous expenses, not exceeding W100,000-

Endorsement for Martyr
The Company will pay the indemnity in accordance with the provisions of this endorsement for bodily injury incurred by any Accident Bodily Injury sustained by the Insured Person and caused under the circumstances defined hereunder Martyr Courtesy Act (martyr to risk bodily injury or his own life for cause) and Enforcement Decree of Martyr Courtesy Act . Such Accidental Bodily Injury Sustained by the Insured Person and caused by any sudden and accidental happening to rescue the third party (life, bodily injury, material property) but not for the course of employment.

Where to start? Way too many hours 130. Rolling Eyes and thats just classroom hours add in the 20 minutes early every day + any marking etc...all for the low low price of 2 mil Rolling Eyes Hours from 9:30 to 7:00 thats a long long day!...9.5 hours a day makes 47.5 hours+ a week...add in the 20 minutes before class Razz

I'm with Grotto, this contract stinks.

Here's what a newbie should shoot for as a bare minimum for a kiddie hogwon job:

2.0 million for 120 teaching hours/mo
free non-shared apartment
roundtrip airfare from and to the nearest international airport to your home
block shift (no more than 8 hours between your daily start and finish time, get that in writing)
health insurance, 50% of premium paid by you, 50% by employer
Monday-Friday schedule, NO SATURDAYS
2 weeks vacation
all national holidays off (no need to make them up)
any overtime is optional, paid at the rate of 120% of your standard hourly pay


This job has too many hours for the minimum pay, a loooooooong 10-hour on site work day, forced overtime, and they are breaking the law and cheaping out by giving you a skimpy travelers insurance plan instead of getting you on the national system. Just say no to this job.

The only two issues that would stop me from signing it are the shared accomodations and that they ask you to pay back your flight over at any point in your contract. The other poster was right when they said that you shouldn't have to pay it after 6 months.

The crappy hours would be the deal breaker for me. So would the shared accommodations.

There is no mention of pension, which is mandatory. The medical insurance is crap...they are breaking the law by offering you private insurance.

A crappy contract.

Thanks for all the info, very helpful. I didn't know about the national insurance plan. In my case, shared accomadation is okay because I am traveling with someone. However I am curious about what is an acceptable rate for income tax and also I am confused about pension...can you explain this further?? Are there ways to exempt oneself for either?

Income plus residence tax should be in the neighborhood of 2-3%. It's very low here, most of the tax revenue here comes from a sales tax.

As for pension, every worker in Korea is required to pay 4.5% of their income into the national pension fund. Their employer must match this contribution. It works out to just under W100,000 per month from each side per month on a 2 million/mo salary, or about 2 million won/year total. Americans and Canadians are eligible for a refun of all of this when they leave the country. Workers from the UK, NZ, Australia, Ireland and South Africa will get none of this back unless they retire in Korea in their sixties.

In short, if you are North American, you definitely want to put matching contributions in because this is an extra million won per year. If you aren't, you probably don't really want to be paying in, although you are still legally required to pay in, and it may catch up with you some time in the distant future if you don't.

You can do better or start negociating with this school to amend the contract....
