Hi all -
I would greatly appreciate it if you all could look at this contract for me. Any and all help is greatly appreciated! Also, the school is called KNC, anyone ever heard of it, good or bad??
Hours are 4 -9pm, teaching elementary and middle school students. Also, I have spoken with a current teacher and he said that there are a few teachers who have renewed their contracts - good sign, right?

1. INTRODUCTION:
This is an agreement between (hereinafter called `the instructor') and XXX Language School (hereinafter called `the school'). The instructor agrees to teach students at the school at the times designated by the school management, and agrees to develop and present educational programs for the students. The instructor agrees to follow and strictly comply with the School's policies and guidelines during the period of this agreement.
2. CONTRACT DURATION:
(A) It is hereby agreed between the school and the instructor that the instructor shall teach at the school from May 1st 2006 to April 31st 2007 .
(B) If the instructor wishes to renew his/her contract at the end of one year, he/she must inform the School one month prior to the end of one year's service, and the contract may, if both parties agree, be renewed at that time for another year by mutual agreement.
3. RESPONSIBILITIES OF TEACHER:
(A) The instructor will teach Monday through Friday, a total of one hundred and twenty hours of English language classes per month. The precise number of teaching hours in a month will depend on the number of official or statutory holidays which fall in that month.
(B) The instructor's teaching hours shall be determined by the School's schedule and shall conform to any changes, which take place in the school's scheduling.
(C) The instructor is responsible for familiarizing himself or herself with all institute materials relevant to teaching at the School. The instructor shall faithfully teach and train students at locations designated by the School.
4. TEACHER'S SALARY:
(A) The teacher's total monthly salary shall be 2.0 million won . The teacher's annual salary will total 24 mil. Won . This compensation is in exchange for teaching an average of 6 hours a day, five days per week Monday to Friday totaling 120 hours a month during the contract period.
B) An end of contract bonus of 2.0 million won will be paid upon the satisfactory completion of the contract.
(C) If an instructor teaches, by mutual agreement of the instructor and employer, additional teaching hours, overtime compensation at a rate of 18,000 Won per hour shall be paid for those hours.
(D) The instructor's salary will be paid monthly on the 10th for payment of instructor's salaries.
5. VISA SPONSORSHIP
(a) The process of VISA sponsorship will be presented by the school.
6. HOUSING:
(A) The school will provide a private furnished one bedroom apartment to the teacher.
(B) The teacher's apartment furnishings shall include: basic cooking utensils such as pots pans and dishes, a stove, a refrigerator; a bed with clean linen, a washing machine, a closet and a TV.
(C) Costs for all utilities, including lighting, heat, water, and maintain fee shall be borne by the teacher. If the teacher lives in shared accommodation with other teachers, these utility costs will be shared by the apartment dwellers.
(D) Any refundable deposits for telephone connections to their apartments will be paid by the school.
7. VACATION TIME:
(A) The teacher shall enjoy 10 days of paid vacation for each year. The paid vacation will be normally 5 days for Summer and 5 days for Winter. But the schedule can be changed and followed by school��s schedule.
(B) The teacher shall enjoy Korean national holidays for each year.
8. INCOME TAX:
Approximately 3.3 % per month of the instructor's salary shall be deducted by the employer as withholding tax as provided by Korean law.
9. KOREAN MEDICAL INSURANCE:
50% of the health and accident insurance fees offered from the designated insurance Company will be provided by the employer. The coverage will be in accordance with the policies of the Insurance Company.
10. DUTY OF SECRECY:
(A) The instructor shall not disclose any of the contents of this agreement, including salary, to a third party (including other employees of the school)
B) The instructor shall not disclose any information relating to the contents of lecturers and business operation of the School without prior permission of the School. Violation of this portion of the contract will cause the Instructor to be responsible to compensate the School for all possible losses suffered by the School.
11. ADDITIONAL DUTIES:
(A) The instructor is required to conduct him/herself in a professional manner and to wear neat attire while at the school. Casual clothing is acceptable, provided that it is neat and clean.
(B) The following forms of behavior will not be permitted.
1) Not following scheduled class timetables and dismissing, canceling, or starting classes late without the prior approval of the school director.
2) Conducting class while under the influence of alcohol, while smoking, or under the influence of illegal drugs.
3) Making sexual advances towards, or entering in to relationships with students or employees or the School.
(C) The school shall have the right to terminate this contract if the instructor violates the contract or fails to conduct him/herself in a professional manner. At least one month advanced notice of termination will be given to the instructor. If the instructor wants to leave the school before the contract ends, he/she should give two months notice to the school. In these cases, the school has no duty to give the severance pay bonus to the instructor. In addition, the teacher has to return the round trip airfare if he/she leaves within six months.
(D) Sick Day: if the instructor is sick and cannot come to work, the person should inform the school before the class begins, and the pay of the day will be deducted from the salary and the money will be given to whomever teaches the absent instructor��s classes.
12. Both parties have carefully read this contract; They have agreed to its terms in good faith; and they will attempt to resolve any disputes, which may arise in accordance with the terms of the contract, and in a reasonable manner. All disputes which cannot be resolved by the parties to this contract will be resolved through the legal system of Korea in accordance with Korean law.

Nice hours and teachers resigning is usually a good sign.

? if you are working from 4-9 thats 25 hours a week which is 100 hours a month. I would change this to reflect that. If you leave 120 hours you can bet that they will take advantage of that!

I dont like this clause either....your 4-9 schedule could quickly be changed! Stick with set times and hours. If they want to change the hours they should be willing to pay more!

Sorry buddy but you are only legally entitled to teach at one location(unless of course each and every other location is okayed by immigration)

Pay is low....push for 2.2 minimum! Once again your 4-9 has changed from 5 hours to 6 hours....make sure the correct hours are in your contract throughout it!

25,000 won per hour or 20,000 per 50 minute class.
(D) The instructor's salary will be paid monthly on the 10th for payment of instructor's salaries.
Kind of late.....It should be paid by the 5'th(or even the end) of the month. Some hogwans use this holdback of pay to prevent midnight runs!

DEMAND AC, summers in Korea are hellishly hot!

Shared should not even be mentioned in this contract!

HELL NO! Income tax on 2 mil is only 1.5% DO NOT LET THEM STEAL YOUR MONEY THIS WAY!

NHIS is the company and that is the only insurance company allowed for FT's(or is it?)

? YOU should get at least 3 sick days per year! That they are not giving you any sick days is another red flag! That they expect you to pay for the replacement teacher unfreaking believable!

All disputes which cannot be resolved by the parties to this contract will be resolved through the legal system of Korea in accordance with Korean law.
Another crap contract. Low pay, the ability to change the hours/schedule at will, no sick days , multiple teaching locations, high tax, no mention of pension....its not a good contract! Forward this back to them and tell them to go jump in a lake! It never ceases to amaze me as to the garbage people consider signing! |
