hello gentlepeople,
push is coming to shove. i have aked now maybe six times for my tax receipt from the end of my last contract (march 2). last week she said this week, and yesterday she said at the end of may when she files her taxes.
i have decided to call tax office helpline for foreigners and ask if i can demand. then i plan to simply go and file next week, letting her know of course that i will be going. i also understand from another link that there is a form i can request that will show me taxes paid for the year. i will ask for that. i inderstand at the tax office that they will ask me for my statement of tax withholding, and when i say my employer wont give to me, they may initiate their own action.
i know i have overpaid...about 860,000 during the last contract.
the question is this. what tools are available, short of a very expensive lawyer, to force my employer to reimburse me? does labor take up this sort of thing, or only the tax office? Does immigration have a say in this?

as always, comments, links and flames welcome.

Hello, I have the same problem. My school owes me 760,000 won overpaid taxes for 2005 & 2006.
No luck yet. My Director has said, go to the tax office, I'll not pay it, I'll pay it next year, I'll pay in in May, I pay after summer vacation. I don't have to pay it,
He's just pi$$ing me about. It's obvious he has no intention of refunding this money. Everytime I try and discuss this with him he just says: We talk about this more later (and then runs away).

I am really fed up I'm thinking of resigning and using the 760,000 won tax debt as a leverage to get a Letter of Release.

Any comments on how to improve this situation would be appreciated. I'm getting really annoyed with this.

If you go to the Korean National Tax office website www.knts.go.kr (????) the Foreigners Help Line Telephone Number is at the top left hand side.

I spoke to Mr Koo several times.
He was very polite and helpful.

Yes, if you don't get a tax refund every year, your employer is the 1 screwing you. At our university, our January pay is always a few hundred thou higher than normal and it is our tax refund which they automatically file for us and get back and refund to us automatically.

Hmmm...My present school does not take taxes out and that I suspect, is because it's a state Univ. Once I worked at a Hogwan (BCM Kangnam) and they took taxes and paid back my overpaid amount. My question is...why are you still at a school that is ripping you off? Enough already, report them to the relevant authorities and give your notice! Also, write the school up on the blacklists. It's time we teachers "just said NO" to disreputable outfits. When they can't find a teacher they'll know why and change their ways!

My last employer is under tax investigation because he didn't want to pay the taxes he withheld from my salary to the national tax service. I don't know whether I'll see that money or not.

As for my current employer, I over paid taxes for 2004 by about 300,000 won and it was refunded to me in May along with a completed tax assesment. This year, I received almost 700,000 in overpaid tax back along with my completed assesment.

They don't give refunds here? They do if you file and your employer has paid your withholding taxes.

Cheers

update....
ok,
i called the tax office. i called immiagration. made VERY polite inquiries, and they were very helpful. Well, they answered all my questions and offered to call for me. I had another meeting with said director, and with the choice of either responding to government inquiry, or simply reimbursing, the director chose the latter.....plus some...

ah, also just read alojovoz post here......WTF??? where did that come from?
