Is it legal to sponsor an E-2 VISA and then offer the person the choice of being a salaried employee with pension, medical, etc... or being an independent contractor and making more money but having none of those benefits?

I have worked at 2 companies now that do the latter. If it is not legal, what kind of VISA would you get to teach as an independent contractor - not as a wage earner?
