If you are fired from a job do you automatically recieve a letter of release? Or is it still up to your boss if they want to give it to you?

It's totally up to your boss if he/she wants to give it to to you. Your boss is not under any legal obligation to give a LOR if you're fired or quit.

Make this a condition of your leaving, and inform them that you'll take them to the labour board if you don't get one.

If you're fired, then you don't need a Letter of Release.

The Letter of Release is only for when you voluntarily quit a job.

Just make sure that your boss reported your firing to immigration, thus canceling your E-2, and remember you have two weeks to leave the country from the date of your firing.

Now that's one way to get out of a contract - get yourself fired LOL Laughing ! Good advice. Walk into your boss's office and say, "please fire me, pretty please, I'm begging you." Take in your little tape recorder too.

JackintheHat- Is that really true???? I am not questioning your experience here, but is it that simple?
1. Get fired
2. Get visa cancelled
3. Find a new job within 2 Weeks
4. Leave the country
5 Wait for new visa to be issued.
6 Come back to Korea and begin working

Did I miss any steps?

So, getting fired and OR a LOR is about the same thing?

Can the company that fired you NOT cancel your visa?

That's the problem.

There is nothing to gaurantee that your boss will get off his arse and go to immigration to cancel your visa, and in many cases they don't do it because they know it will effectively stop the teacher from being able to get another job and E-2 visa.

Even if you do get fired, you still need a Letter of Release if your boss won't go to immigration and cancel your visa.

He has 2 weeks to advise immigration. You can go to immigration yourself and advise them that the school has terminated your employment and you wish to surrender your ARC and grab your exit order and hit the road. I know so much has been said about LOR's, but my wife and I have never had one in 5 years of teaching here. It's never been a problem. Smile

Okay, so you leave the country and come back in. Is it possible to get a new E2 visa before your original E2 visa expires? If you are on a single entry visa, this should be the case right?
