HELP!!! Recruiter trying to force me to work illegally!

How frustrating! I have (or, rather I should say HAD) been working with this one recruiter on a position that starts in June.

When I told him my uni was going to take a longer time than I expected to get transcripts (they told me 5 days at first, then called me and said 4 weeks), I told him I wouldn't be able to take the job because I didn't want to work without my E2 visa. (I've been here several years, I know the score).

He has spent the past 2 days telling me that as long as my documents were SUBMITTED to immigration, it is totally legal to work with no visa. He claims that it is the way to get around transcripts taking a long time -- send everything in but transcripts, then when immigration asks for the transcripts, the boss can say they are on the way, and at that point I will be totally legal to work because I have something "in process" at immigration.

I've told him several times that I am not interested in working illegally and that I will have to wait another month if that's the case, to find a new job. He won't back down, I eventually had to tell him to GTH.

It just pissed me off, that's all -- HE's not the one who gets in trouble if I am found out be working illegally.

I wish there was a way that recruiters could also be charged by immigration if they put a teacher in a school illegally. If I was a newbie, I most likely would have believed him and taken the job.

You did the right thing.
Immigration seem to look the other way if the school has submitted all docs, (incl. transcripts) and you are simply awaiting a visa issuence number.
But I have never heard of them allowing teachers to work whilst they are waiting for transcripts.
In fact, your docs would probably not be at Immigration yet if you are waiting for your transcripts. Schools usually submit them all together.
And you are right, the only ones who cop the fine is the teacher and the school. Recruiters get nothing.

Well, see that's the thing -- they want to submit my degree now, and "play dumb" about the transcripts, so that they can begin processing. The recruiter says that the school will get a "file number" for me, which is, in his words "Just as good as a visa" Shocked

I do suspect that immigration would likely "look the other way" as you put it, but at the same time, it's not a risk I'm willing to take. It just burns my arse that a recruiter is trying to put ME in that situation.

Compared to another recruiter who told me that if I wanted to take a position now and work illegally it was my choice; they would not push me either way on it, and if I wasn't sure of the consequences they would explain them to me, and then I could make my own decision. When I said "no thanks" they said "smart choice." What a difference.

There have been practices by recruiters/employers of making the same claim to other unsuspecting teachers. The teachers have then commenced working for the school, only to find several months later, still without an E-2, that the recruiter/employer never actually submitted any of the documents to immigration.

That's why it's wise to insist not working until you have the E-2 in your hands, regardless of whether it is in actual fact legit or not to start working while your documents being processed.

You did the right thing. It may have been so a hundred times before, but you will be the poor bunny that gets caught. Better to be safe than sorry. Smile

The recruiter is looking out for him/herself...they just want to get paid....if you dont come right away they dont get paid and have to find another chump to come.

You did the right thing...kudos!

Isn't there a way that you can put pressure on your university to get the transcripts more quickly? I mean, four weeks is a bit ridiculous to get a piece of paper. I would call and yell at them for a bit. But that's just me.

OK, I thought this situation was a done deal, and I wasn't worried about it -- I really only posted that to let others (newbies mainly) know that recruiters will try anything.

BUT I just got another phone call from him, now he is threatening me. He claims that I never told him I wouldn't take the job, the school is waiting for me, I've cost him money, etc etc. (I did tell him, on Monday, that I wasn't taking the job).

He has told me he is going to report me to immigration and the police, I laughed at him -- there is nothing I have done wrong, I never signed a contract, all I did was verbally accept a job, and then back out when I found out I would have to work illegally.

The worry I have is that he can of course, make something up to take to immi or police. He has no information about me but my cell phone number (which is regstered under my alien card number), and my resume which has my current living address. He doesn't have my passport number.

Anwyay he was screaming at me, I was screaming back at him, I eventually told him to "go to h***" and hung up.

Can he actually DO anything???????

P.S. Yes, I have avoided his phone calls the past day or so, because I am sick of his pressure. The only reason I answered it this morning is because he called from a different number, I didn't know it was him.

Call your phone company and ask them to put a block on his number.

OR

When he calls....just put the phone on a chair and let him yell away.... Twisted Evil .....after all he's paying for the call Laughing

My transcritps came in 4 days!!!! Any chance you could post the name of the recruiter!! I am a newbie and am currently looking for a position through many recruiters so this would be a great help

When he calls next time say this to him:
