I'm still very up in the air if this is the next step I want to take in my life, but the contract seems pretty decent to me, but you all know much more about this than I do. So, here it is:

Clause 1[ Purpose ]
This contract is made for the purpose of setting forth the terms and conditions of employment for native English teachers who work in LCI.

Clause 2[ General Appointment ]
1. The Employer agrees to employee as an English Instructor of a LCI school during the period stipulated herein. In signing this mutual agreement, we each understand fully our responsibilities and obligations to the other party.
2. This Employment Agreement will be issued and completed in duplicate for the records of Teacher and LCI.
3. Employment elsewhere shall not be permitted in accordance with Korean law.

Clause 3 [ Period of Employment ]
The total Agreement term is approximately one year, commencing from the first date _August/21/2006_ of teaching in Republic of Korea and to the last
(Month/day/year)
teaching day __August/21/2007_ of the contract.

Clause 4
[ Supervision ]
Teacher will work closely with LCI program supervisors and other colleagues in the planning, observation and review of instruction. LCI will observe Teacher�s class informally for help at any time, and formally according to a given schedule for evaluation of Teacher.

Clause 5 [ The Employees duties ]
Teacher will respect the written, verbal, and tacit rules and standards of conduct of LCI.
Written rules and standards of conduct of LCI are as follows:
1. Teacher must follow the advice and direction of the principal and academic director.
2. Teacher must have lessons prepared prior to the start of any class.
3. Teacher must be punctual at all times.
4. Teacher must attend all staff meetings � 4-5 times per month.
Staff meetings and school events will be scheduled at the discretion of the LCI director. The attendance of Teacher is mandatory. Staff meetings will allow time for discussion of topics of current concerns within the program such as new policies, procedures, methods of training, instruction, curriculum and other matters as needed. LCI staff is encouraged to help work out practical solutions to problems at these meetings.
5. Teacher must take enough rest on Sunday evening in order to be energetic on Monday.
6. Teacher may be assigned many classes and can be changed without notice, also should follow directions.
7. The preparation time, students, evaluation and staff meetings are not considered as teaching time.
Teaching time is considered to be time spent instructing in the classroom.
8. Teacher should keep his/her students� records such as attendance, evaluation, test forms, test results, conference meeting records, classes� program or supplements etc�
9. LCI will have one day workshop ( include performance day, parent meeting) during
the year contract and will be held on Saturday or Sunday or a weekday evening.
Please note this workshop is considered as part of the teacher�s monthly salary and
the teacher doesn�t receive extra pay for this workshop.
10. Teacher must obey the laws, regulations, instructions, and ordinances of the
national and local Korean governments. The onus is on Teacher to become familiar
with Korean laws, regulations, instructions, and ordinances prior to arrival. Teacher
is required to be punctual, reliable and professional in representing LCI.
11. Casual wear is acceptable; however, jeans with holes, wrinkled or dirty clothes, and
sweat pants are not considered proper attire.

Clause 6
[ Work Schedule ]
1. The workweek runs from Monday through Friday. Hours of operation are from 09:00 to 6:30pm. Daily class instruction hours are 6 hours and 50 min. and material preparation hours are 1 hour and 30 min.
2. Teacher will be scheduled to teach during this time period by the LCI Director. There can be a possibility of long preparation time between classes. Teacher will usually, although not necessarily, be scheduled in shifts. Teacher needs to follow LCI.
3. If class instruction hour is less than 6 hours 50 minutes per day, Teacher will be required to devote the remaining hours to related academic work under the supervision of the LCI academic coordinator.

Clause 7 [ Salary ]
1.The Employer agrees to pay the Employee a monthly salary of __2,500,000___won, paid in Korean currency.
2. The salary will be paid on a monthly bases. Each month's salary is calculated based
on 1 hour and 30 min. of preparation hours plus 6 hours and 50 min. of actual instruction hours.
3. The salary will be paid per month on the 5th of the following month.
If the 5th falls on a Saturday, the employee will be paid on the 4th, and if it falls on a
Sunday, the employee will be paid on the 6th.
4. The first month and the last month�s salary will be based on the teacher�s actual working days. ( Monthly salary� working days of the month(Mon.~Fri.) �actual teaching days. Orientation period is not included in actual teaching days.)
5. 400,000Won will be paid to the teacher in advance when Teacher arrives to the school and will be deducted from the first month�s salary.
6. If Teacher should be absent from work without having obtained a prior approval, Teacher�s salary for that month shall be deducted by the amount calculated on a pro rata basis for the number of unauthorized absent days.
7. If the instruction hours are reduced to less than 6 hours and 50 min., the monthly salary will be deducted by 16000 won per each missing hour of the instruction hours.
8. Teaching hours that exceed the contracted daily hours(6hours 50min.) are remunerated at 16000 won per one hour. Teacher could be required to work any additional hours that LCI may request. All instructors are required to substitute for other teachers who may be sick or absent.

Clause 8 [ Severance Pay ]
Upon successful completion of the one-year contract, LCI will issue Teacher
__2,500,000_ won as a severance pay.

Clause 9 [ Benefits ]
Teacher shall be paid an amount of ___200,000__won per month in recognition of the degree held by Teacher and his/her work experience.

Clause 10 [ Orientation Period ]
1. Upon arrival in Korea, the Teacher may be allowed ten days adjustment time and
preparation for school prior to the beginning of regular classes.
2. During the orientation period the Teacher should be inside the school learning about the school system.
3. During the orientation/observation phase the Teacher will receive payment of 70,000won per day, regardless that the Teacher might have to teach a few classes for the purpose of training.

Clause 11
[ Sick Day & Pay Deduction ]
1. Teachers will have one paid sick day only with the doctor�s diagnosis. A doctor�s invoice with the diagnosis and prognosis is required to be paid for sick days.
. In addition, if the paid sick day is not consumed at the end of the contract, the unused sick day will be paid 100,000won.
2. LCI may deduct a day�s pay for each day Teacher is absent from work for other reasons except for illness or inevitable reasons or Teacher used paid sick days.
3. If Teacher does not arrive on time after vacation, LCI may deduct two days� pay per day.

Clause 12
[ Tax ]
South Korean income tax will be withheld automatically from the monthly salary of Teacher. Income tax on the monthly salary and the severance payment runs at about 3.3%.

Clause 13 [ Deposit ]
Teacher agrees to pay the employer a housing management deposit to cover unpaid monthly service, utility and telephone charges. Such deposit, amounting to 400,000 won and being payable to the employer in two equal installments, will be deducted from Teacher�s salary during the second and third month of employment. Teacher agrees that the deposit will be returned, in full, to the Teacher at the time of the completion of the Teacher�s period of employment with employer. The employer will hold the full amount of the deposit until all outstanding monthly service, utility, and telephone charges have been paid. In the event that the employer makes payments covering monthly service, utility and telephone charges on behalf of the Teacher, the amount of such payments will be deducted from the deposit and the remainder of the deposit returned to the Teacher.

Clause 14 [ Vacation ]
LCI will give Teacher a one-week paid vacation during the summer and a one-week paid vacation during the winter. These vacation times will be determined by LCI and generally follow annual school closures. Teacher is responsible to be at LCI on time. If Teacher does not arrive on time, LCI may deduct two days� pay per day.

Clause 15 [ Airfare ]
LCI will issue Teacher a one-way airfare ticket, free of charge, from the nearest international airport to Korea prior to the departure. But if Teacher is fired or is willing to leave before completing of this contract, Teacher must pay back the one-way airfare to the employer. Upon successful completion of the one-year contract, LCI will issue Teacher a one-way airfare ticket, free of charge, from Korea to international airport to employee�s nearest home.

Clause 16 [ Housing ]
1. LCI will provide Teacher with free accommodation. Teacher will have a studio. Furnishings provided by LCI include a bed, a small wardrobe, a kitchen table and chairs, a gas range, an air conditioner, a refrigerator, a house telephone, a television, and a washing machine. In a public room, a computer with internet, and a water purifier will be provided. Teacher has a responsibility to pay maintenance expenses for all individuals.

2. Teacher has a duty to keep the house in good status. LCI may not pay full accommodation cost when this is not properly followed.

Clause 17
[ Medical Insurance ]
Teacher will have health, accidental injury, and death coverage through Samsung Insurance Company Limited. LCI will pay the monthly premium on behalf of Teacher. Teacher is responsible to understand his or her coverage.

Clause 18 [ Termination of the Contract ]
1. If Teacher is absent on three occasions without notice, LCI reserves the right to terminate this agreement by issuing Teacher written notification of termination forty days in advance. Termination of employment with LCI is immediate and without notice for serious cause: such as

- two written notices have already been issued
- drunkenness on the job
- sexual misconduct
- outside employment
- irresponsible working

2. Written notices can be issued for any of following.
- unexplained absences from work.
- Arriving late without notice or reason.
- Verbal abuse towards children or staff members.
- Breaking any of the stipulations agreed to by the Employer and the Teacher in the signed contract.

3. Teacher agrees to give written notice forty days before this agreement ends of his/her intention to renew or terminate this agreement.

Run. You will be working a ton of hours (7 hours class time + 1.5 hours prep time!). The business about reducing your salary if you don't teach 7 hours a day is ludicrous -- it says if class is canceled, they will find other work for you but not pay you for doing it! The overtime rate -- do the math, it is nowhere close to what it should be. You would have no control over your vacation time. Overall if you sign this contract there is a very high chance that you will burn out in record time.

The main good point about this contract is how upfront they are about the amount of anal-eaze you should bring with you.

Not true - delete. You may work anywhere that is permitted by immigration.

VERY LONG days -
Penalty clauses -
You take HIS business risks - if he consolidates classes you get a salary deduction.


Pretty sucky - My personal advice - NO WAY JOSE

Six 50-minute classes/day is the norm. Not 5.
20,000 pre 50 minutes of OT is the norm. Not 40 minutes. OT is anything more than 6 teaching hours/day. It's caluclated daily. Anything before your start time and after your end time in your schedule is OT.

Just so you're not misinformed.

Anyway, forget this contract.

My typo 6 classes and not 5 classes (x 50 minutes) is correct and I have made the correction in my critique.

I have been getting 20K per 40 minute class for the last 3 years... 25k for a 50 minute class... This is also the standard public school rate for extra classes.

Another red flag......scheduled at the discretion...not a good thing!

If you are only paying for teaching time thats all you get...if you want people wasting time their time at meetings and writing bullcrap evaluations pay them for it....if you dont then Razz

10. Teacher must obey the laws, regulations, instructions, and ordinances of the national and local Korean governments. The onus is on Teacher to become familiar with Korean laws, regulations, instructions, and ordinances prior to arrival.

Yes its up to you to find out because they will rip you off left right and center if you remain ignorant of your rights!

Teacher is required to be punctual, reliable and professional in representing LCI.
11. Casual wear is acceptable; however, jeans with holes, wrinkled or dirty clothes, and
sweat pants are not considered proper attire.

Clause 6 [ Work Schedule ]
1. The workweek runs from Monday through Friday. Hours of operation are from 09:00 to 6:30pm. Daily class instruction hours are 6 hours and 50 min. and material preparation hours are 1 hour and 30 min.

Long days! Their math doesnt add up either.....they say 8 hours twenty minutes of time but the 9-6:30 is nine and a half....where did that other hour go?

2. Teacher will be scheduled to teach during this time period by the LCI Director. There can be a possibility of long preparation time between classes. Teacher will usually, although not necessarily, be scheduled in shifts. Teacher needs to follow LCI.

3. If class instruction hour is less than 6 hours 50 minutes per day, Teacher will be required to devote the remaining hours to related academic work under the supervision of the LCI academic coordinator.

No thanks this isnt paid you said! If you cant fill the classes then too freaking bad!


Clause 7 [ Salary ]
1.The Employer agrees to pay the Employee a monthly salary of __2,500,000___won, paid in Korean currency.
2. The salary will be paid on a monthly bases. Each month's salary is calculated based
on 1 hour and 30 min. of preparation hours plus 6 hours and 50 min. of actual instruction hours.

still only adds up to 8 hours and 20 minutes...where is that other hour ten going? Not a bad salary but not worth the headaches IMHO

3. The salary will be paid per month on the 5th of the following month.
If the 5th falls on a Saturday, the employee will be paid on the 4th, and if it falls on a
Sunday, the employee will be paid on the 6th.

Salary is paid on or before payday...late payment is a violation of your contract!

4. The first month and the last month’s salary will be based on the teacher’s actual working days. ( Monthly salary� working days of the month(Mon.~Fri.) �actual teaching
days. Orientation period is not included in actual teaching days.)

salary is salary! You pay by the month not by the days! babo!


5. 400,000Won will be paid to the teacher in advance when Teacher arrives to the school and will be deducted from the first month’s salary.
6. If Teacher should be absent from work without having obtained a prior approval, Teacher’s salary for that month shall be deducted by the amount calculated on a pro rata basis for the number of unauthorized absent days.

not acceptable!

7. If the instruction hours are reduced to less than 6 hours and 50 min., the monthly salary will be deducted by 16000 won per each missing hour of the instruction hours.

Not a chance! It is their responsability to schedule classes! Only a moron would agree to a clause like this!

8. Teaching hours that exceed the contracted daily hours(6hours 50min.) are remunerated at 16000 won per one hour. Teacher could be required to work any additional hours that LCI may request. All instructors are required to substitute for other teachers who may be sick or absent.

not a chance anyone who works for less than 20,000 won overtime is a sap!

Clause 8 [ Severance Pay ]
Upon successful completion of the one-year contract, LCI will issue Teacher
__2,500,000_ won as a severance pay.

Clause 9 [ Benefits ]
Teacher shall be paid an amount of ___200,000__won per month in recognition of the degree held by Teacher and his/her work experience.

Clause 10 [ Orientation Period ]
1. Upon arrival in Korea, the Teacher may be allowed ten days adjustment time and
preparation for school prior to the beginning of regular classes.

Doesnt usually happen.

2. During the orientation period the Teacher should be inside the school learning about the school system.
3. During the orientation/observation phase the Teacher will receive payment of 70,000won per day, regardless that the Teacher might have to teach a few classes for the purpose of training.

Clause 11 [ Sick Day & Pay Deduction ]
1. Teachers will have one paid sick day only with the doctor’s diagnosis. A doctor’s invoice with the diagnosis and prognosis is required to be paid for sick days.
. In addition, if the paid sick day is not consumed at the end of the contract, the unused sick day will be paid 100,000won.

you should have at least 3 sick days paid!


2. LCI may deduct a day’s pay for each day Teacher is absent from work for other reasons except for illness or inevitable reasons or Teacher used paid sick days.
3. If Teacher does not arrive on time after vacation, LCI may deduct two days’ pay per day.

Guess what! Illegal, immoral and stupid....after vacation just dont show up ever again...I bet that happens alot with these wackos!

Clause 12 [ Tax ]
South Korean income tax will be withheld automatically from the monthly salary of Teacher. Income tax on the monthly salary and the severance payment runs at about 3.3%.

Clause 13 [ Deposit ]
Teacher agrees to pay the employer a housing management deposit to cover unpaid monthly service, utility and telephone charges. Such deposit, amounting to 400,000 won and being payable to the employer in two equal installments, will be deducted from Teacher’s salary during the second and third month of employment. Teacher agrees that the deposit will be returned, in full, to the Teacher at the time of the completion of the Teacher’s period of employment with employer. The employer will hold the full amount of the deposit until all outstanding monthly service, utility, and telephone charges have been paid. In the event that the employer makes payments covering monthly service, utility and telephone charges on behalf of the Teacher, the amount of such payments will be deducted from the deposit and the remainder of the deposit returned to the Teacher.

Just say no!

Clause 14 [ Vacation ]
LCI will give Teacher a one-week paid vacation during the summer and a one-week paid vacation during the winter. These vacation times will be determined by LCI and generally follow annual school closures. Teacher is responsible to be at LCI on time. If Teacher does not arrive on time, LCI may deduct two days’ pay per day.

Illegal!

Clause 15 [ Airfare ]
LCI will issue Teacher a one-way airfare ticket, free of charge, from the nearest international airport to Korea prior to the departure. But if Teacher is fired or is willing to leave before completing of this contract, Teacher must pay back the one-way airfare to the employer.

I guess it isnt free of charge then is it! After 6 months you shouldnt be libel for the airfare here!

Upon successful completion of the one-year contract, LCI will issue Teacher a one-way airfare ticket, free of charge, from Korea to international airport to employee’s nearest home.

Clause 16 [ Housing ]
1. LCI will provide Teacher with free accommodation. Teacher will have a studio. Furnishings provided by LCI include a bed, a small wardrobe, a kitchen table and chairs, a gas range, an air conditioner, a refrigerator, a house telephone, a television, and a washing machine. In a public room, a computer with internet, and a water purifier will be provided. Teacher has a responsibility to pay maintenance expenses for all individuals.

2. Teacher has a duty to keep the house in good status. LCI may not pay full accommodation cost when this is not properly followed.

Clause 17 [ Medical Insurance ]
Teacher will have health, accidental injury, and death coverage through Samsung Insurance Company Limited. LCI will pay the monthly premium on behalf of Teacher. Teacher is responsible to understand his or her coverage.

now illegal! All foreigners must be covered by NHIC!

Clause 18 [ Termination of the Contract ]
1. If Teacher is absent on three occasions without notice, LCI reserves the right to terminate this agreement by issuing Teacher written notification of termination forty days in advance. Termination of employment with LCI is immediate and without notice for serious cause: such as

- two written notices have already been issued
- drunkenness on the job
- sexual misconduct
- outside employment
- irresponsible working

2. Written notices can be issued for any of following.
- unexplained absences from work.
- Arriving late without notice or reason.
- Verbal abuse towards children or staff members.
- Breaking any of the stipulations agreed to by the Employer and the Teacher in the signed contract.

3. Teacher agrees to give written notice forty days before this agreement ends of his/her intention to renew or terminate this agreement.

Just run! Dont walk away....RUN AWAY! Shyte contract for a shyte company....look up the blacklists...these guys are all over them!
