I've heard that you won't lose your severance pay if you're into your second year with the same employer and you quit before your contract is up. You'll get your full first year's severance plus whatever months you did work in the second year. The second year's severance is prorated. Is this true? |

My question is: Who wouldn't get their severance pay for year one, after their first year? You'd have to be pretty trusting (or pretty stupid). |

If you get your severance at the end of your fisrt year and then keep working for the same employer but not for another full year you are not legally entitled to a prorated severance under Korean Labor Laws.
If you don't get you severnce after completing a year and keep working for the same employer then you're entitle to your first years severance and a prorated severance for what ever extra time you were employed.
This is according to the Korean Labor Laws.
If your employer argues otherwise I can give you a link to or copy of the Korean Labor laws so you can show him. I just don't have it handy right now, sorry. |
