I saw a post of yours on daveseslcafe and I was wondering if you had any advice. I quit my job at Boston Lang uage School in Ansan last Monday, June 5th. After two sincere attempts (one time I got lost on the trains and one time the taxi driver took me to a place called "M.B.C." instead of the U.S. Embassy,) I failed to get my 30-day visa extended before Saturday, June 10th - when my tourist visa expired.

Today I called the U.S. Embassy to explain my situation. I couldn't get through after many tries, so I called a foreign help number that I got. I told the man my situation and he told me that I should've read Korean immigration laws before I came over. He said I shouldn't have been hired by my school without a work visa. He told me I have to go back to the U.S. or my school and I could pay a immigration fine and I could work somewhere else. He went on to say that if I called or visited the U.S. Embassy at this point they would be angry at me.

All this seemed a little harsh considering tourists can usually get a 90-day tourist visa. I was wondering if you could shed any light on my situation. Are there any loopholes like going to China or Japan and returning?

Sincerely,

Jeff Baumann

Jeff.... you are hooped.... You were working illegally AND you are now in an overstay position on your visa waiver stamp (you didn't have a visa - just a 30 day stamp).

Your embassy cannot help you very much about your problem. (see links below) but you should contact them IN PERSON and not by phone.

3. Familiarize yourself with local laws and customs of the countries to which you are traveling. Remember, the U.S. Constitution does not follow you! While in a foreign country, you are subject to its laws.

10. If you get into trouble, contact the nearest U.S. embassy.

Your option at this point is to make arrangements to get money from home to pay your fine (if you're lucky it will only be 100,000 won for the overstay) and get on a plane out of the country.

Your embassy CAN help you contact people from home to send you money, recommend a lawyer (but that won't help you here). Never mind the phone call crap... get on a subway and get to the embassy.

They MAY (but not likely) assist you with contacting immigration to get the mess cleaned up, contact folks from home to get money to pay your fines and help you get re-patriated.

"ACS supports the work of our overseas embassies and consulates in providing emergency services to Americans in cases of arrest..."

"ACS can facilitate the transfer of funds overseas to assist U.S. citizens in need, ... and help U.S. citizens who are detained in foreign prisons. In other words, ACS is here to assist you and your family whenever and wherever we can."

Good luck dude... be at the embassy at 9am... and immigration as soon there after as you can make arrangements.

OR he can go to korean immigration and work things out there. If he has a plane ticket out of the country, he should go to the office in Mok-dong, explain the situation (just say you were visiting a friend, i'd leave the work part out Wink ).

I overstayed my work visa by a few days and all I had to do is sign a waiver saying I wouldn't repeat the offense again.
