| I'm looking for an article that discusses or explains the principle that the least injured person is held responsible for a fight. I'd also like something that talks about the system of paying to have charges dropped -- I mean, I'm right in thinking that that is pretty uncommon in the west, yeah? I'd certainly never heard of it being routine in the States. |

| In the US we pay fines in lew of court all the time depending on the offense. This can not be done with felony charges. |

There is a common concept in Anglo-Saxon justice of blood-money, which is the payment of money to the hurt party to compensate for injury or even death. But that's been gone for centuries, of course.
In Korea, it's probably listed under the article saying "the foreigner shall always be considered in the wrong."

Finding an article in English will probably be near impossible. You might be able to find something in Korean, but that might be tough unless you can read Korean well.
My advice is to find a Korean to help you find and translate the article. |

Some keywords for the search.
"폭력 행위 등 처벌에 관한 법률" (the laws about the punishment for violent acts)
"쌍방 폭행/상해" (mutual violence)
"손해 배상 책임" (responsibilities for the compensation for damages)
I couldn't find exaclty what you are looking for. Maybe I will try again later. |
